SUBJECT: Transfer A Portion of SR 60 Off The State Highway System, And Realign It On
Three City Streets Proposed For Transfer To The State Highway System, In
Pinellas County
District Secretary Hartmann requests approval of the transfer of a portion of SR 60 from the
State Highway System to the City of Clearwater. The portion to be transferred consists of
Cleveland Street and Gulf-to-Bay Boulevard from west of Pierce Boulevard to Highland
Avenue for a total of2.370 miles. Three city streets, Pierce, Chestnut and Court, are proposed
for addition to the State Highway System for a total of 1.787 miles. These additions will be
numbered as SR 60. This transfer was requested by the City of Clearwater because it aids in the
redevelopment of the downtown area. No historic structures or archaeological sites will be
affected by these transfers.
The transfer of SR 60/Cleveland Street/Gulf-to-Bay Boulevard, including the old existing
Memorial Bridge, shall be effective upon construction acceptance of the new Memorial Bridge.

A RESOLUTION OF THE CITY OF CLEARWATER,
FLORIDA, AUTHORIZING A ROADWAY TRANSFER
AGREEMENT WITH THE FLORIDA DEPARTMENT OF
TRANSPORTATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Clearwater has requested the transfer of SR 60/Cleveland
Street/Gulf-to-Bay Boulevard from 0.476 miles west of Pierce Boulevard to Highland
Avenue, from the State Highway System to the Clearwater Road System, and the transfer
of Pierce Boulevard/Chestnut/Court Streets from 280' south of Cleveland Street to SR
651/Missouri Avenue and Court Street one-way westbound from Chestnut/Court Streets
to Court/Pierce Boulevard from the Clearwater Road System to the State Highway
System; and
WHEREAS, the transfer is mutually agreed upon, between the City of Clearwater
and the Florida Department of Transportation; and
WHEREAS, the City Commission hereby authorizes the City Manager and Mayor-
Commissioner to sign the transfer agreement described in the resolution; and
WHEREAS, said transfer is in the best interest of the City of Clearwater because it
aids in the redevelopment of the downtown area; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:
Section 1. A certified copy of this resolution shall be forwarded forthwith to the
State of Florida Department of Transportation in Tallahassee, Florida.
Section 2. This resolution shall take effect immediately upon adoption.

TillS AGREEMENT made and entered into this 21 st day of August, 2000, by and between the
FLORIDA DEPARTMENT OF TRANSPORTATION, an agency of the State of Florida, hereinafter called
the DEPARTMENT, and the CITY OF CLEARWATER, hereinafter called the CITY.
WITNESSETH
WHEREAS, the CITY has requested the transfer ofSR 60/Cleveland Street/Gulf-to-Bay Boulevard
from 0.476 miles West of Pierce Boulevard to Highland Avenue, and this transfer is mutually agreed upon,
between the CITY and the DEPARTMENT,
NOW, THEREFORE, THIS INDENTURE WITNESSETH: in consideration of the mutual covenants
and promises herein contained, and for other good and valuable consideration, the receipt and adequacy of
which are hereby acknowledged, the CITY and the DEPARTMENT agree as set forth below:
This Agreement sets forth the terms and conditions under which the CITY and the DEPARTMENT will
abide, commencing on the date of approval by the Secretary of the Florida Department of Transportation.
TERMS OF THE AGREEMENT
I.
Roadway Transfer ofSR 60/Cleveland Street/Gulf-to-Bay Boulevard from 0.476 miles West
of Pierce Boulevard to Highland Avenue, from the State Highway System to the City of
Clearwater Road System:
(a)
The CITY accepts all responsibility for operation and maintenance of the roadway. In addition to
the roadbed, this agreement includes all curbs, culverts, and drainage structures within the right-of-
way at the time of transfer. The CITY shall be responsible for maintenance ofpublic sidewalks and
other ways in the right-of-way.
(b)
The DEPARTMENT gives up all its rights to the road, except as specified in this agreement.
(c)
It is agreed that all obligations of the DEPARTMENT under any maintenance, utility, or any other
such agreement, relating to this specific road to be transferred, shall be transferred to the CITY at
the same time and in the same manner as jurisdictional responsibility. The roadway transfer ofSR
60/Cleveland Street/Gulf-to-Bay Boulevard including the existing Memorial Bridge shall be effective
upon written notification of final construction acceptance ofthe new Memorial Bridge and approval
by the Secretary of the Florida Department of Transportation.
(d)
Existing deeds or right-of-way maps will be recorded by the CITY in the public land records of
Pinellas County in which the rights-of-way are located,

(e)
Ifthere is evidence of historical or archaeological resources that could be adversely impacted
after a transfer, the CITY agrees to maintain the resources in accordance with District
Environmental Management Office(DEMO) recommendations.

Cleveland Street to SR 651IMissouri Avenue from the City of Clearwater Road System to the
State Highway System:

This Agreement embodies the whole agreement ofthe parties. There are no promises, terms, conditions, or
obligations other than those contained herein, and this Agreement shall supersede all previous
communications, representations, or agreements, either verbal or written, between the parties hereto.
This Agreement shall be governed by and construed in accordance with the laws ofthe State of Florida.

Each Party is an independent contractor and is not an agent ofthe other party. Nothing contained in this
Agreement shall be construed to create any fiduciary relationship between the parties, during or after the
performance of this Agreement. Neither party shall have the authority to bind the other party to any
obligation whatsoever to any third party without the express specific written consent of the other.
No modification, amendment, or alteration in the terms or conditions contained herein shall be effective
unless contained in a written document executed with the same formality and of equal dignity herewith.
If any part of this Agreement shall be determined to be invalid or unenforceable by a court of competent
jurisdiction or by any other legally constituted body having the jurisdiction to make such determination, the
remainder of this Agreement shall remain in full force and effect provided that the part ofthis Agreement
thus invalidated or declared unenforceable is not material to the intended operation ofthis Agreement.

Dear Mr. Roberto:
The Department agrees to the transfer of SR 60/Cleveland StreetlGult:to-Bay Boulevard off the State
Highway System and onto the City of Clearwater Road System requested by the City. A map
depicting this proposal is attached. The Department will coordinate with the City on reaching mutual
agreement in accordance with Section 335.0415, Florida Statutes. Items to be considered are
provided in the attached Terms of Agreement. The Department requires a Resolution from the City
authorizing the execution of the Transfer Agreement with a statement that the local governmental
entity agrees with the terms and conditions found in the Transfer Agreement. This resolution will be
attached to the Final Transfer Agreement.
These specific transfer requirements will include, as determined applicable by the Department and
your representative, the considerations outlined in the attachment.
