THIS AGREEMENT, made and entered into this ~ day of
~ril , 1987, by and between the STATE OF FLORIDA DEPARTMENT
o TRANSPOR'rATION, herelnafter called the "DEPARTMENT", and
the CITY OF CLEARWATER, FLORIDA, hereinafter called the "CITY':';
WIT N E SSE T H :
WHEREAS, the DEPARTMENT is preparing to undertake a project
within the City identified and known to the parties as Project
No. 15645-3602, Federal Aid No. M-1337-(2), which will be of
benefit to the CITY; and
WHEREAS, approval of Federal Aid necessary to the project
requires agreement by the CITY to maintain the project;
NOW, THEREFORE, in consideration of the premises, the parties
agree:
1. The DEPARTMENT will undertake to perform the work for the
project and obtain approval for Federal participation.
2. Upon completion and acceptance of the project, the CITY
will assume responsibilities for maintenance of that portion of the
project lying within the corporate limits of the City, and will
conduct such maintenance in accordance with the federally approved
state standards.
3. This agreement shall not be construeQ as a waiver by either
party of the defenses and limitations available to either party
pursuant to Section 768.28, Florida Statutes, or successor pro-
visions thereto.
IN WITNESS WHEREOF, the parties hereto have set their hands and
affixed their seals on the day and year first above written.

A RESOLUTION OF THE CITY OF CLEARWATER,
FLORIDA, AUTHORIZING THE EXECUTION OF
THE JOINT MAINTENANCE AGREEMENT BETWEEN
THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION AND THE CITY.
WHEREAS, the CITY OF CLEARWATER, FLORIDA, deems it in the public
interest to enter into the attached agreement witn the STATE OF
FLORIDA DEPARTMENT OF TRANSPORTATION relative to maintenance of
said Project with the STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION
on State Project No. 15645-3602, Work Program Item No. 7126512,
Federal Aid No. M-1337-(2), and Location Descriotion: Highland-
Patricia at Union Street;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
CO~IISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The CITY OF CLEARWATER concurs in the prOV1Slons
of that certain agreement attached hereto pertaining to the CITY
OF GLEARWATER participation with the DEPARTMENT OF TRANSPORTATION
ln the project described above.
Section 2. The CITY OF CLEARWATER- authorizes the said agreement
to be executed by its proper officers.
Section 3. This Resolution shall be effective immediately
upon adoption.
