Crowe 701 94th Ave. North, Suite 130, St. Petersburg, FL 33702 LAWTON CHILES, GOVERNOR CALVIN ROSS, SECRETARY ., (, \__/ '"' , ,. ., I STATE OF FLORIDA DEPARTMENT OF JUVENILE JUSTICE AGREEMENT FOR COMMUNITY-BASED SUPERVISED WORK PROGRAM The Department of Juvenile Justice hereby enters into an agreement with the Clearwater Police Department to provide community service work program site(s) for juveniles who have, pursuant to Chapter 985 Florida Statutes, been made the responsibility of the Department of Juvenile Justice. On-site supervision of juveniles in this work program will be the responsibility of Department of Juvenile Justice Case Managers and/or Clearwater Police Department staff. The Department of Juvenile Justice, having prima!;' responsibility, win be responsible for paying any Worker's Compensation claim that any juvenile would be entitled to recover pursuant to Chapter 440, Florida Statutes. The Department win, at an times, have access to its juveniles who are performing in such work program to verify the appropriateness of the program. The Department further agrees to indemnify and hold the City, its employees, and agents harmless from any and an claims, suits, judgments and liability for death, personal injury, bodily injury, or property damage arising out of acts committed by the juvenile during the juvenile's participation in the work program, including legal fees, court costs, or other legal expenses. Pursuant to Section 768.28(18), Florida Statutes (1997), the Department shan not indemnify the City, its employees, and agents, for any negligence committed by the City, its employees, and agents. However, nothing herein shall be deemed to be a waiver of the immunity afforded to the City, its employees, and agents pursuant to Section 985.231(1)(g), Florida Statutes (1997).
