Dear Mr. Galbraith:
This will confirm our telephone conversation of
December 5, 1990. The purpose of the call was to inform you that
the Division of Administrative Hearings intends to raise the
hourly rate it charges for Hearing Officer services provided to
the City of Clearwater to $100.00 per hour. The new rate will
apply to cases filed after December 31, 1990.
At your request, I spoke with the Director and
Assistant Director about the possibility of raising the hourly
rate to only $90.00. The Division has already entered into three
new contracts with other agencies providing for a $100.00 an hour
rate. Therefore, we do not believe it would be acceptable to
charge one local government at a lower rate than we are charging
others. Accordingly, we cannot agree to a $90.00 an hour rate.
If the change to the agreement between the City of
Clearwater and the Division is acceptable, please advise by
return letter, and the exchange of letters will be deemed to
constitute an amendment to the agreement.
Unless the amendment is acceptable to the City, the
Division will be unable to provide Hearing Officers for cases
re,ferred to us after January 14, 1991, and this letter shall
serve as notice of termination of the agreement.
