The Personnel Dirp.:ctor1 s letter was -receivp.:c too l;"Lte for consideration during the City Commission meeting of November 7, 1985, and a decision to act upon the request during the commission meeting of November 21, was not made. I take the two letters to indicate that the Civil Service Board has rejected the City Commission's suggestion that the Board first attempt to use the mutual arrangement between the legal departments of the cities of Clearwater and St, Petersburg where either city may call upon an attorney from the other city to provide legal advice when needed (copy attached) . At the commission meeting of November 21, 1985, the City Commission did approve funding for independent counsel for the Civil Service Board in the Christopher Kingsley case, The City Attorney will advise you of the details of the action taken by the City Commission in this case. At the work session of December 2, I will recommend that your request for funding for legal counsel to represent the Civil Service Board in other pending actions against the Board be placed upon the agenda of the commission meeting of December 5, 1985, for consideration and action. II The purpose of this ~o~ion is to request independent legal counsel for the Civil Service Board for the specific area referred to in the motion. This is pursuant to Section 25.04 (d), last sentence of the City Code which provides that llupon request by the Civil Ser".:ice Board the City Corr=ission may in its discretion provide said Board independent counsel," The request is T:lac.e in relation to the Board hearing a Grievance or er!"l'ployee P.aYIllond Parke. Mr. Parke initiated a Grievance under provisions or the Grievance Procedure or the CooT:"lunications \~]orkers of America Union Contract. This Grievance reached che third level of (he Union Contract Grievance Procedure at which point it was denied. The C\~A declined to pursue the Grie\;ance in arbitration. Thereupon, the employee expressed his desire to process chis Grievance under Civil Service Grievance Procedures. At the Board's ~e~~ing in SepteIT.ber, the Board was provided with a recent Florida Supre~e Court decision mace available by the City Attorney's Office. In that this case ~as sub~itted by the City Attorney's Office to support the contention that the enployee cannot process his Grievance through Civil Service procedures, Chairman i~alsh noted :hat the City Attorney's Office could not advise the Board on this issue. Accordingly, he requesred a motion for independent counsel to advise the Board on the application of t~e case relied upon cy :ne City in the Parke case. Ayres, a State Hearing Officer, of an appeal by a City employee of disciplinary action taken by the City, the Board requested the City administracion to make an inquiry to the State to determine if the State would agree to rotate Hearing Officers assigned to hear Clearwater employees civil service appeals. I am happy to report to you that the Department of Administration, Division of Administrative Hearings has responded to the City's, inquiry in the affirmative, Mr, Thomas C, Oldham, Assistant Director, has assured the City that in the future they will assign cases on a rotating basis to the several Hearing Officers who hold hearings in this area. Based upon our understanding or the purpose of the questions, I am hopeful that this assurance of rotation will resolve the problems that have arisen regarding the use of State Hearing Officers, and that we can now request the assignment of State Hearing Officers to hear pending cases and future cases. Regarding a related issue, you recently, in an undated letter to the Mayor and City Commissioners, requested the Commission to authorize funds for the Civil Service Board to obtain competent and independent legal counsel of its choice, Co represent ic in the suit filed against the Board by the City, It appears to me that the response by the State, regarding the rotation or Hearing Officers to hear Clearwater employees civil service appeals, has made it possible to resolve other pending actions.
