Dear Mike:
Attached are two copies of the Use Permit for the fire tower. Both
copies have been executed by Commissioner Conner. Please have exe-
cuted by the City of Clearwater and return one copy to me.
The tower will be available to you when released by District Forester
Hebb. As you know, we cannot remove the tower until we remove the
radio equipment. We will move the radio equipment as soon as we get
FCC authorization.
Mike, I wish you much success in this program and should I go through
Clearwater and have the time, I would like to see your project after
it is completed.

This Use Permit made and entered into this /Y
between the Department of Agriculture & Consumer
Forestry,
the Permittor, and the City of Clearwater, Florida, the Permittee, witnesseth:
1. That the Permittor, for and in consideration of the agreements hereinafter
mentioned and set forth, does hereby permit unto the Permittee for a period
of ten (10) years from this date, the use of the following described Look-
out Tower:
Division of Forestry Lookout Tower, identification number 007313,
80 feet tall, with full use of the tower, to manage and control
for the intended uses during the life of the lease.
2. The Permittee agrees:
A. that within one (1) year from this date it will remove said tower from
its present site (Dunedin Work Center) and erect it on their property
in the City of Clearwater,
B. that the tower shall be used for educational purposes of the citizens of
the City of Clearwater and State of Florida,
C. that the tower, during the hours that such facility is in operation,
shall be accessible to the citizens of the City of Clearwater and State
of Florida for ascending and descending in pursuing the educational
values therefrom,
D. that the City of Clearwater will maintain the tower in a satisfactory
and acceptable manner, such as painting, replacing bolts, steps, and
landing boards, etc.,
E. that it will not deface or disfigure the tower so that it cannot be used
as a lookout tower when returned to the Division of Forestry. The act
of modifying the lookout cab so as to permit attachment of a windmill
shall not be construed to be an act of defacing or disfiguring the tower
within the meaning of this paragraph.
F. that it will hold the Permittor harmless from any acts by them or the
public in the use of this tower.

3. It is mutually agreed:
A. that this permit may be renewed, at the option of the Permittee by
written notice to the Permittor sixty (60) days prior to termination
date, upon the same terms and conditions, for an additional ten (10)
years,
B. upon failure of the Permittee to perform or carry out any of these
covenants and agreements herein contained, this permit shall stand
terminated and shall be and become null and void; and upon termina-
tion of this permit for any cause, the Permittee shall immediately
dismantle the tower and deliver to the Permittor at 5745 South Florida
Avenue, Lakeland, Florida 33803 in good condition and repair, ordinary
wear and tear excepted.
Executed, in duplicate, this day and year aforesaid.
