AMENDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT made and entered into this
the 11th day of January A.D. 1978
by and between the CITY OF CLEARWATER, FLORIDA, a municipal
corporation, hereinafter
referred to as "City", and FOREST DEAN and WILLADENE C. DEAN, and
NORMAN KIRKLAND, JR. and MARGARET KIRKLAND, hereinafter referred
to as "Owner";
WITNESSETH:
WHEREAS, the City and Owner on September 30, 1977, entered into
an Agreement where
the City agreed to furnish sewer service to the Owner
pursuant to the terms of such Agreement; and
WHEREAS, such Agreement was recorded in O. R. Book 4605, page
1846, of the Public Records of Pinellas County, Florida; and
WHEREAS, it is necessary to amend such Agreement to provide a new
legal description relating to the property which is to be made subject to the
terms of such Agreement;
NOW, THEREFORE, the parties hereto Covenant and agree as follows:
1. That the legal description set out in the first WHEREAS clause of
the Agreement dated September 30, 1977, and recorded in O. R. Book 4605,
page 1846, of the Public Records of Pinellas County, Florida, is hereby
amended to read as follows:

15 East, run S 89021'56" E, 33.0 feet along the North line of said
Section to the East right-of-way of County Road #34; thence
S 00017'00" W, 301.07 feet along the East right-of-way of County
Road #34 to the intersection of said East right-of-way of County
Road #34 and the South right-of-way of the Seaboard Railroad;
thence South 529. 88 feet; thence East 17 feet to the P. O. B.; thence
run S 89042'57" E, 414.63 feet; thence run N 00017' 00" E,
399. 70 feet to the South right-of-way of the Seaboard Railroad;
thence run N 72056'00" W, 433.08 feet; thence run S 00017'00" W,
524.75 feet to the P. O. B.
2. That apart from the amendment set forth above, the terms and
conditions of the Agreement dated September 30, 1977, is hereby ratified
