Section 133.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of

In accordance with Section 133.09 of the Code of Ordinances of the
City of Clearwater, I have reviewed your request for a temporary
sidewalk installation waiver.
The above-cited property does not meet the requirements as set forth
in the aforementioned Code, paragraph (e) because an existing sidewalk
is located with 200 feet of the property (on Tropic Hills Drive abutting
subject site). Therefore, I cannot grant a temporary waiver of the side-
walk installation requirement on the above-cited property and your
request is denied.

We have been requested by Lokey Motors to waive the sidewalk requirement in front
of the new dealership being built on U.S. 19 at Tropic Hills Drive. A lot of
confusion has arisen in regard to this request because of indications by the
Florida Department of Transportation that they do not wish to have any sidewalks
built within the right-of-way of U.S. 19 due to future widening projects. We
have made several calls to the Department of Transportation and have been unable
to get anyone to make that statement to us. On June 4, 1985 I contacted Mr. Zimmer
of J.W. Pettit Company, who is constructing this project, and advised him to submit
the application to the Department of Transportation to force someone to either
sign it or reject it. I have been advised by DOT personnel that if the City
requires the sidewalk to be installed the DOT will grant the permit.
This sidewalk is located along a strip where no other sidewalk exists. However,
this site is part of a strip of 1,300' of vacant land and the expectation is that
development will occur on the other properties to the north. Granting the sidewalk
waiver at this location will automatically qualify the others for sidewalk
waivers.

1. There are no sidewalks within 200 feet of the
dealership.
2. D.O.T. does not want the sidewalk in the R/W.
3. There is no school foot route or traffic in the
subject area.
