LETTER OF AGREEMENT
It is hereby agreed between the City of Clearwater (owner) and
E. Palomino Dairy, Inc. (user) that the user will continue to
prepare, plant and harvest hay and other feed crops on the owner's
property for the mutual benefit of both parties.
The benefit to the owner is the proper maintenance of the sludge
disposal acreage by growing and harvesting crops necessary for
nutrient removal. The benefit to the user is the value of the
crops harvested~
Conditions of the agreement are as follows:
The Owner will:
1. Provide approximately 500 acres of land suitable for
farming, located in Hillsborough County on Patterson
Road, which is referred to as the sludge farm.
2. Provide soil conditioner in the form of liquid digested
wastewater sludges. Said sludges to be applied on the
property when and where required for proper plant growth,
with the mutual understanding that the total volume of
sludge hauled to the farm site is determined solely by
what is needed for optimum efficient operation of the
City's three treatment plants, Sludge application will
be done by either city employees or contract haulers.
3. Maintain roadways, gates and fences on sludge farm property.
4. Monitor, test or analyze sludges to assume that environ-
mental standards are followed.
The user will:
1. Continue to pay to the City of Clearwater the sum of
$625.00 per month as per previous lease agreement.

The user will:
2. Provide the City with a copy of adequate liability insurance
which includes the City of Clearwater as the property owner and
an additional insured. Said policy to protect the City's liability
and should include the 65 acres at the Northeast Wastewater
Treatment Plant, as well as the 500 acres on Patterson Road. As
in previous agreement, said policy to be kept in force for the
duration of this agreement.
3. Prepare, plant and harvest feed crops in the same manner which
has been demonstrated under past agreement.
4. Provide mowing service on approximately 65 acres of grass fields
at the City's Northeast Wastewater Treatment Plant, as needed, and
twice yearly bale accumulated cuttings into small rectangular bales
for use by the City's Public Works Dept. The frequency of mowing
and baling to be determined by the Water Pollution Control Division
Superintendent.
5. Continue to work closely with owner's representatives on a day to
day basis for proper farm management.
6. Shall always maintain or hold in reserve property for sludge
disposal in case of heavy rains. The City must always have a
disposal site regardless of the weather.
The user or owner may teminate this agreement for good cause upon a 3D-day
Notice of Proposed Termination.
This agreement shall be for a period of 12 months from the date of execution
and at the end of 12 months may be renewed, upon renegotiation, on a year to
year tenancy basis.
If the conditions in this agreement meet with your approval, please sign
three copies of this letter and return all three to me. I shall return an
executed copy to you as soon as possible.
