March 18, 1981 Attached is agreement between the City of Clearwater and E Palomino Dairy, Inc. regarding maintenance of sprayfields at the Northeast wastewater sewage treatment plant for addition to your files. Smith Vice-President and Secretary E Palomino Dairy, Inc. 366 Garden Lake Circle Odessa, FL 33556 LETTER OF AGREEMENT It is hereby agreed between the City of Clearwater (owner) and E Palomino Dairy, Inc. (user) that the user will prepare, plant, and harvest hay or other cattle-feed crops on the owner's land for the mutual benefit of both parties. The benefit to the owner is that of having its wastewater treat- ment sprayfields maintained. Benefit to the user will be the use of crops grown and harvested on these sprayfields. Conditions of agreement are as follows: The owner will: 1. Provide approximately 65 acres of land at the Northeast waste- water sewage treatment plant (see Exhibit "A"). 2. Provide water in the form of treated effluent from the Northeast wastewater sewage treatment plant to be sprayed on crops using the owner's irrigation system. 3. Provide the irrigation system in good working condition prior to user's acceptance of same. 4. Provide a secure parking place for user's vehicles within the fenced area of the Northeast wastewater sewage treatment plant. 5. Clearsprayfields F and G of dense growth and will rough grade these fields within 90 days of the execution of this letter of agreement. 6. Rotate irrigation of these sprayfields in order to facilitate harvesting by the user. / / "Equal Emplayment and Affirmative Action Employer" 60 --057C~ 7. Provide the City with a copy of its insurance policy and keep said policy in force until the conclusion of this agreement. 2. Prepare and plant on fields A, B, C, and D, to show performance within a 90-day trial period. Thereafter, user may plant on all available acreage covered by this agreement. 3. Assume maintenance responsibility of sprayfield irrigation system and make repairs to sprayheads and piping which may be damaged as a result of planting or harvesting operations. Repairs must be completed within a five-day period. 4. Operate sprayfields without the use of fertilizers and sewage sludge. 5. Use only City-approved herbicides within a four-foot radius of each spray head. 6. The addition of any chemicals to the sprayfields must be approved by the City. 7. Remove crops when harvested within four weeks. 8. Do all the work'and furnish the materials, equipment, supplies and labor to keep a City-approved crop growing on the tracts being used. The user or-the -owner may terminate this agreement for good cause upon a 3D-day notice of proposed termination. If at the end of a 90-day performance trial period, the user hs demonstrated satisfactory results, then this ,agreement shall continue for nine months. At the end of 12 months from execution of this agreement the user is on a month-to-month tenancy. If the above conditions meet with your approval, please sign three copies of this letter and return all three to me. I shall return an executed copy to you as soon as possible.
