NATURAL GAS EXPANSION PROGRAM I t A G R E E MEN T GAS CONSTRUCTION COORDINATOR FOR THE NATURAL GAS EXPANSION PROJECT THIS AGREEMENT, made and entered into this ;;(S~ay of ___~ ' 19~, by and between the CITY OF CLEARWATER, FLORIDA,) a municipal corporation, hereinafter referred to as "City"" and EDWARD W. MAYNARD , hereinafter referred to as "Contractor"; WIT N E SSE T H ------ - WHEREAS, the City is conducting a Natural Gas Expansion Program consisting primarily but not entirely of main line con- struction, and WHEREAS, the City Utilities Director has been designated Project Director and the City Gas Superintendent has been designated as Project Superintendent for the City; and WHEREAS, said project is deemed to be of such special character as to render its accomplishment most expedient by con- tracting for services in connection with the operations of the City owned natural gas system; NOW, THEREFORE, in consideration of the promises, and of the faithful performance by each of the parties of the covenanbs 'and agreements by the other made, it is mutually agreed by the parties as follows: 1. The Contractor shall provide the services set forth in Exhibits A & B, the Scope of Services and Conditions of Service attached hereto and made a part hereof as if fully rewritten herein. 2. The City shall compensate the Contractor in accordance with the terms and conditions of this agreement, set forth in Exhibit B, Conditions of Service, attached hereto and made a part hereof as if fully rewritten herein, and as follows: A. Compensation for contract standard services shall be at the unit rate of $ 12.85 per hour for each hour of satisfactory services accepted in accordance with the scope of the work, with the City guaranteeing a minimum of 20 hours a week. Compensation to be made at time-and-one-half over 40 hours per week. 3. Work on the Project by Contractor is to be started and is to be completed by unless otherwise renewed or terminated as provided herein. 1 -' o,s (o~6 -{)~-Jf I I 4. In place of progress reports, the City retains the right to inspect the work and services being provided pursuant to the Scope of Services and Conditions of Service to determine if the Scope of Services and Conditions of Service are being satisfied. 5. This contract may be terminated at any time by either party upon ten (10) day's notice. Should the City exercise the right of termination, then the Contractor shall be compensated in accordance with the provisions of this agreement for services per- formed to the date of termination. 6. The Contractor shall not subcontract any of the service set forth in the scope of services without written consent of the City. 7. This agreement may not be assigned or otherwise trans- ferred in any manner. 8. This agreement shall be construed in accordance with the laws of the State of Florida. '-.-- Witnesses: ~7Jt~ 11 ~.<<& ~ As To Contractor · r ~L~~L(SEAL) Contractor - 2 - I I EXHIBIT A SCOPE OF THE WORK: GAS CONSTRUCTION COORDINATOR FOR THE NATURAL GAS EXPANSION PROJECT The work to be provided under this contract shall be planning, advising, and coordinating various sections of the Gas Expansion Program as directed by the Utilities Director or his Assistant. Work shall be related to the Gas Expansion Project anywhere in the Gas System. Work shall include, but not be limited to, the following: Estimate and assist in the purchasing of materials. Design and prepare construction contracts for gas projects. Assist inxhe preparation and coordination of permits and applications. Meet with officials, representatives, and inspectors re- garding gas construction. Contact prospective gas customers and assist in the design and processing of new connections. Inspect work in progress on a periodic basis and prepare progress reports on construction. Any other work related to the Gas System expansion as required. - j - I I EXHIBIT B CONDITIONS OF SERVICE: CITY AND CONTRACTOR 1. Contractor shall furnish his own transportation up to 200 miles per week at no additional cost to the City. All mileage in excess of 200 miles will be paid at Twenty cents per mile. 2. Contractor shall furnish the following insurance coverage at his cost: A. Comprehensive coverage on the vehicle - minimum coverage. B. General liability - minimum coverage. 3. The City will furnish the Contractor with a desk and chair in the Utility Administration Office and will furnish all necessary office supplies and materials. 4. The Contractor may take vacation without pay when approved in advance by the Utilities Director.
