Attached is information related to the request of E.J. Robinson, Construction
Manager of Neighbor Works Home Ownership Center for a one-year extension of the
Development Order of the above referenced project.
The Community Development Board (CDB) approved the application on July 18,
2006 with a Development Order expiration of July 18, 2007.
In accordance with the provisions of Section 4-407 of the Community
Development Code (Code) for good cause presented in writing I granted a one-year
extension to July 18, 2008 for the submission of an application for a building permit to
construct the site improvements conforming to the original developrnent order for the
case.
Pursuant to Section 4-407 of the Code, The CDB may approve one additional
time extension after the community development coordinator's extension to initiate a
building permit application. Such extension shall not exceed one year, shall be for the
project originally approved and shall be for good cause shown and documented in
writing. The CDB must receive the request for this extension within the time frame
granted by the Planning Director. Good causes may include but are not limited to an
unexpected national crisis (acts of war, significant downturn in the national economy,
etc.), excessive weather-related delays, and the like. The CDB may also consider whether
significant progress on the project is being made and whether or not there are pending or
approved Code amendments that would significantly affect the project.
The attached letter references the condition of the housing market as the reason
for the request and was received within the period of validity of the original extension.

Dear Mr. Robinson:
On July 18, 2006, the Community Development Board (CDB) approved your Flexible Development approval to
construct a new single family residence in the Medium Density Residential district with reduction to the
minimum lot area from 5,000 square feet to 4,143 square feet and a front (south) setback reduction from 25 feet
to 13 feet, as a residential infill project, per section 2-304.G.
On June 13, 2007, you submitted a request for a time extension to apply for a building permit to construct the
improvements on this parcel. Your letter cited unsold new home inventory and slow sales as the reason for the
request.
In accordance with the provisions of Section 4-407 of the Community Development Code, I find your request
timely and APPROVE a one-year time extension to July 18, 2008, to submit an application for a building
permit to construct the site improvements conforming to the original development order for the case. All
required Certificates of Occupancy shall be obtained within two years of the date of issuance of the initial
building permit.
The CDB may approve one additional extension of time after the Planning Director's extension to initiate a
building permit application. Such extension shall not exceed one year, shall be for the project originally

Dear Mr. Robinson:
This letter constitutes a Development Order pursuant to Section 4-206.D.6. of the Community Development
Code. On July 18, 2006, the Community Development Board (CDB) reviewed your Flexible Development
approval to construct a new single family residence in the Medium Density Residential district with: reduction
to the minimum lot area from 5,000 square feet to 4,143 square feet; and a front (south) setback reduction from
25 feet to 13 feet, as a residential infill project, per section 2-304.G. The CDB APPROVED the application
based upon the following Findings of Fact and Conclusions of Law and subject to the attached conditions of
approval:
Findings of Fact:
1. The 0.095 acre subject property is located within the Medium Density Residential (MDR) District and the
Residential Urban (RU) Future Land Use Plan category;
2. A single family residence is a permitted use;
3. Adj acent uses consist of a wide mix of single family residential, offices, and industrial uses;
4. Due to the variety of uses and building types in the immediate vicinity there is no established front setback
characteristic along Eldridge Street;
5. The proposed single family residence will make the property and the immediate area safer for persons
residing in the neighborhood;
6. The proposed single family residence will be in harmony with the scale, bulk, coverage, and density of
adjacent properties;
7. The proposed is compatible with the adjacent properties; and
8. The proposed will enhance other redevelopment efforts in the Community.
Conclusions of Law:
1. That the development proposal is consistent with the Flexible Standard Development criteria as per Section
2-304.G ofthe Community Development Code;
2. That the development proposal is consistent with the General Applicability Criteria as per Section 3-913 of
the Community Development Code; and
3. The proposed development is compatible with the surrounding area.

Conditions of Approval:
1. That no parked vehicle will block or obstruct the sidewalk in accordance with City Ordinance 30.041 (1 )(b);
2. That the site plan be revised to show the finished floor elevation and lot grading on NA VD 88 datum prior
to the issuance of a building permit; and
3. That the final design of the building and site plan be consistent with those approved or modified by the
Community Development Board.
Pursuant to Section 4-407 of the Community Development Code, an application for a building permit shall be
made within one year of Flexible Development approval (by July 18, 2007). All required Certificates of
Occupancy shall be obtained within two years of the date of issuance of the initial building permit. Please be
advised that time frames do not change with successive owners. The Community Development Coordinator
may grant an extension of time for a period not to exceed one year and only within the original period of
validity. The CDB may approve one additional extension of time after the Community Development
Coordinator's extension to initiate a building permit application.
The issuance of this Development Order does not relieve you of the necessity to obtain any building permits or
pay any impact fees that may be required. In order to facilitate the issuance of any permit or license affected by
this approval, please bring a copy of this letter with you when applying for any permits or licenses that require
this prior development approval.
Additionally, pursuant to Section 4-502.B of the Community Development Code, an appeal of a Level Two
(Flexible Development) approval may be initiated by the applicant or by any person granted party status within
14 days of the date of the CDB decision. The filing of an application/notice of appeal shall stay the effect of
the decision pending the final determination of the case. The appeal period for your case expires on August 1,
2006 (14 days from the date of the CDB decision).
