Since this property is not part of a school route and the waiving of the sidewalk requirement will not create a pedestrian hazard, this location meets the requirements set forth in Section 138.09. Therefore, I am pleesed to inform you that a temporary waiver of the sidewalk requirement is granted on the above- referenced property. Herctlles Avenue DATE: December 14, 1987 This property is located on the northwest corner of Hercules Avenue and Grand Avenue with existing sidewalk along Hercules Avenue. We have reviewed the subject request and found that installation of a sidewalk along Grand Avenue is physically impossible due to an existing ditch. We discussed major drainage improvements with the Engineering Department and found that the ditch adequately serves existing drainage needs. Since the requirements for a waiver are met, it is my recommendation that it be granted. We have also iven the city a 10' drainage and utility easement alan this pro line. There is no room for a sidewalk without making a major adjustment to the drainage system in this area. ~herefore, we feel that because of the current confi uration of the drainage system in this area, we should be granted a sidewalk waiver. section~S.09 of the Code of Ordinances of the City requires that all land that abuts a public right-of-way, which is to have new construction on it, either for residential, co~~ercial, industrial or other purposes, shall have sidewalks constructed by the Owner on, across or adjacent thereto.
