tion waiver.
Since there are no sidewalks within 200 feet of the above-referenced property,
you meet the requirements set forth in the aforementioned Code Section.
Therefore, I am pleased to inform you that a temporary waiver of the sidewalk
installation requirement is granted on the above-referenced property. Should
it be determined that a sidewalk is required at this location in the future,
it will be installed by the assessment process.

that abuts a public right-of-way, which is to have new construction on it,

The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.

This sidewalk is one of those which was granted a waiver in advance due to the
nature of the subdivision being partly developed when a portion of it annexed into
the City. All of the houses along Oak Creek are to have the waiver on Oak Creek,
but not on Landmark Drive.

Dear Mr. Leach:
I realize that the matter of City sidewalk requirements in the Oak
Creek at Countryside subdivision has been up in the air for quite
some time. At the City Commission meeting held February 17, 1983,
I received a concensus from the Conunission to approve future sideHalk
Haiver requests for neH construction in the Oak Creek at Countryside
subdivision.
These waivers cannot be issued unless the proper request is made
through the Building Inspection Department. I am sending a copy of
this letter to Roger Rolfe, the current president of the subject
property owners I association and trust that this information will be
disseminated to the appropriate people.
