Dear Mr. Greene:
In accordance with Section 133.09 of the Code of Ordinances of the City of
Cle&rwater, I have reviewed your request for a temporary sidewalk installa-
tion waiver.
Since there are no sidewalks within 200 feet of the above-refereficed property
fronting on Oak Creek Crive North, you meet the requirements as set forth in
the aforementioned Code section. Therefore, I am pleased to inform you that
a temporary waiver of the sidewalk installation requirement for Oak Creek Drive
North is granted on the above-referenced property. Should it be determined that
a sidewalk is requ~red at this location in the future, it will be installed by
the assessment process.

Keith brought to my attention the fact that I had neglected to be
clear on the above-cited memo regarding sidewalk waivers for this
subdivision. In order to clarify everything, please be aware that
the following must occur:.
1. The owner must apply for a variance.
2. Application fee must be paid and we will go through the
normal process.
3. V~riance is only for the frontage on Oak Creek Drive North,
Oak Creek Drive East~ and Jason Court within our corporate
limits.
4. Lots Nos. 19, 20, and 21 have frontage on Landmark Drive.
The City Commission did not address any anticipated waivers
on Landmark.
These matters should be made clear in any discussion regarding proposed
construction in this subdivision.

Section 133.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the OWner on, across or adjacent thereto.
The OWner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
