Dear Warren:
This letter will confirm and establish the method agreed upon by you and
the City Staff regarding the time period to be utilized by the City of Clear-
water within which to, pay Dyna-Flo Services, Inc. the current rate for
treatment of wastewater from the Clearwater Service Area, approved by
the City of Clearwater, and connected on a temporary basis to the Dyna-
Flo wastewater treatment plant.
As agreed, the City will remit to Dyna Flo Services, Inc. for sewage
treated by Dyna Flo Services, Inc. from the Clearwater Service Area,
the current sewage rate established by the City Commission for all Clear-
water residents. These rates will be subject to change if the Clearwater
City Commission should adjust the rate to Clearwater residents; however,
any change in rate will be the same rate that is being charged to all citizens
of Clearwater.
The City assumes the responsibility of keeping separate accounting records
for those units within the Clearwater Service Area being temporarily ser-
ved by Dyna Flo. These records will be available for your inspection upon
reasonable notice. Based on those account records indicating the sewage
flows being trea.ted by the Dyna Flo Plant from Clearwater, the City will
mail payment 20 days after the billing date for the sewage fees billed for
sewage treated by Dyna Flo during the preceding month.
This letter shall be considered as an addendum to the Agreement for Treat-
ment previously approved by the Clearwater City Commission. If these
arrangements are satisfactory. please sign the acknowledgment provided
below and return two originally signed copies.

TEMPORARY SANITARY SEWER TREATMENT AGREEMENT
THIS AGREEMENT is made and entered into this ~ f-4-t--day of

, 1976, by and between DYNA-FLO SERVICES, INC.. a
Florida corporation, hereinafter r.eferred to as Dyna-Flo, and the CITY OF
CLEARWATER. FLORIDA, a municipal corporation, hereinafter referred to
as City;
WITNESSETH:
WHEREAS, Dyna-Flo presently has a functioning sewage .treatment
facility capable of handling additional capacity for the treatment and disI'osal
of 200,000 gallons per day of wastewater; and
WHEREAS, the City of Clearwater has an existing need for this additional
treatment capacity during the time that the permanent Northeast Wastewater
Treatment Plant is being constructed and made operational;
NOW. THEREFORE, it is hereby agreed by and between the parties
hereto as follows:
1. Dyna-Flo agrees to make available to the City temporary utiliza-
tion of its wastewater treatment facility, and agrees to permit the City to
pump into its facility for treatment and disI'osal a maximum of 200,000 gallons
of wastewater per day.

The amount to be pumI'ed to Dyna-Flo to be determined
by the City, but will not exceed200, 000 gallons per day. Both parties agree
that the City shall have the right to disconnect units served by Dyna-Flo but
within the City at its option anytime during this agreement~
2. During the period of this agreement the City will pay to Dyna-Flo
the monthly sewer charge or fee attributable to those units being served from
the City of Clearwater by the Dyna-Flo plant. The sewer rate remitted to
Dyna-Flo will be the same as that charged other City residents for treatment
and disposal of wastewater, that rate being the rate established by the City
Commission of the City of Clearwater by ordinance.

The City is to receive all tap fees occasioned by the temporary
connection to Dyna-Flo of property located in that area of Clearwater, Florida,
known as the Countryside Addition.

4. This agreement shall run for a period of five (5) years
commencing on the 15th day of July, 1976, and ending on the 14th day
of July, 1981.
5. It is understood by the parties to this agreement that the cost
of all temporary connections to the Dyna-Flo treatment plant from
properties located in the Countryside Addition shall be paid by U. S.
Home, Inc. At such time when the City has the capacity of providing
sewage treatment to those units located in the Countryside Addition
through the Northeast Wastewater Treatment Plant, then those units
will be disconnected from Dyna-Flo treatment plant.
6. Further, the City agrees to make immediately available to
the City of Safety Harbor 100,000 gallons per day of sewage tr eatment
capacity in the City of Clearwater Northeast Interim one (l) million
gallon per day treatment plant.
7. This agreement may be terminated prior to its expiration
date upon the mutual :'l-greement of both parties.
8. This agreement shall be conditioned upon the City Commission
of the City of Clearwater and the City Commission of the City of Safety
Harbor approving an interlocal agreement between both municipalities
related to, the treatment of sanita:"ywastewater from the City of Safety
Harbor in the new Northeast Wastewater Treatment Plant to be constructed
by the City of Clearwater,. Should such an agreement not be approved,
then, this agreement shall not become operational.
9. Both parties agree that the provisions set forth herein constitute

Dear Dave:
By now you should have the executed Agreements between the City of
Safety Harbor and the City of Clearwater for the treatment of Safety
Harbor's wastewater. It was a long time in coming but I believe that
by working together we have contracts that are of benefit to both
municipalities. I want to thank you and the other representatives
of Safety Harbor who worked on the contract and were involved in
the negotiations.
I was reviewing the contract regarding the interim plant and allocating
the 100,000 gallons to Safety Harbor -- and would appreciate your
response to a couple of questions that have arisen.
First, I would appreciate your advising the projected dates for hooking
into the interim plant, and the date when the venturi flow meters will
be installed.
Secondly, I would appreciate rece1V1ng copies of building permits issued,
as well as the meter readings of the flow on a monthly basis to be sub-
mitted to the City of Clearwater Utilities Depar1:1nent. This is needed
information in order that we can keep a record of the amount of the
100,000 gallons being treated as well as what is committed.
Thanks again, Dave, for your cooperation. I hope that we have now
set the stage for further cooperation between Clearwater and Safety ,Harbor.

Dear Mr. Floyd:
Pursuant to the request from your office, we are advising you herewith that
U.S. Home of Florida, Inc. is aware that the City of Clearwater is negotiating
with Dynaflow to furnish interim sewage treatment for a portion of the North-
east service area including a portion of our Countryside development.
It is our understanding that this is to be a temporary agreement until such time
that the City of Clearwater's Northeast Sewage Plant is expanded and trans-
mission facilities constructed. We further understand that upon the completion
of the City's Northeast Sewage Plant and transmission facilities, that any
temporary connection to the Dynaflow facility will be terminated and connection
made to the City's facilities.
\~e do not have any objection to this proposed agreement and, in consideration
of the long lead time required to expand the Northeast Sewage Plant, feel that
such an agreement would be of benefit to the Northeast service area. U.S. Home
of Florida, Inc. will cooperate fully with the City in this matter by routing
all sewage flow possible to the Dynaflow plant immediately upon successful com-
pletion of the City's negotiations.

the fact that the City of Clearwater is continuing to negotiate with
the owners of the Dyna-Flow Sewage Treatment Plant with the goal of
adding to the sewage treatment capacity of the City of Clearwater.
I wish to express to you that I am of the understanding that the
City of Clearwater is hopeful of obtaining a two hundred thousand
gallon capacity by use of the Dyna-Flow Plant on an interim basis
until such time as the million gallon plant is completed and oper-
ational. I understand that the owners of Dyna-Flow wish that the
City of Safety Harbor be allocated one hundred thousand gallons of
this capacity and that one hundred thousand gallons be made availamle
to the City of Clearwater as it may elect.
I believe that this would be constructive and helpful to assure the
participation of Safety Harbor in the use of the northeast plant and
would assist that whole general area to continue to develop on an
orderly basis.
As one of the owners of Northwood Estates, I would like to express
that the developers of Northwood Estates would be in accord with the
City of Clearwater pursuing these negotiations with the owners of
Dyna-Flow to a mutually beneficial conclusion.
