AMEMDMENT TO CONTRACT FOR OURCHASE ORDER NUMBER 2082-91 ," I AMENDMENT TO CONTRACT I THIS AMENDMENT TO CONTRACT is entered into this 22nd day of . July , 1991 by and between Davis Water and Waste Industries, hereinafter referred to as "Davis Water and Waste Industries, " and the CITY OF CLEARWATER, FLORIDA hereinafter referred to as "CITY;" WHEREAS, on July 22, 1991 . . Davis Water and Waste Industries and the City entered into a contract for sludge disposal for the period Auqust 1, 1991, to Julv 31, 1992, per specification of Bid 116-91 by the issuance of Purchase Order No. 2082-91; and WHEREAS, under Section 17-640.300(3), Florida Administrative Code ("F.A.C."), domestic wastewater a residuals generator may enter into an agreement with a contract residuals disposal company to protect themselves from liability related to the disposal of residuals by the contractor; NOW, THEREFORE, in consideration of the mutual promises, t covenants and conditions set forth herein, the receipt and sufficiency of which are acknowledged, the parties agree that the following terms are added to the terms of this contract for residual disposal, which remains in full force and effect as is incorporated herein by reference: 1. The City, as the residuals generator, is familiar and shall comply with the applicable requirements of Chapter 17-640, F.A.C., and shall provide residual material to Davis Water and Industries Waste the residuals land as applicator, which shall meet the chemical criteria for "residuals suitable. for land application" in accordance with Section 17-640.700(2), All delivered F .A.C. residual / /}/ -I o. Davis Water and Waste Industries agrees to accept the responsibility for all Class C residuals treated as required by Chapter 17-640, F.A.C., and delivered by the City to Davis Water and Waste Industries , and agrees to properly dispose of such materials only on a site which has been approved under an Agricultural Use Plan in accordance with Chapter 17-640, F.A.C. Davis Water and Waste Industries agrees that it is aware of and shall comply with the requirements for disposal and site management proper identified in Chapter 17-640, F.A.C. , and the City's wastewater treatment facility permit. 3. Davis Water -and Waste Industries and the City agree to maintain records of the total quantity of residuals land- applied to this site and will file with the Florida Department of Environmental Regulations an annual summary of the total quantity of residuals, heavy metals and nitrogen land-applied to the approved site.
