Gentlemen:
In accordarice with Section 138.09 of the COde of Ordinances of the City of
Clearwater, 1 ha'.flviewed your request for a temporary sidewalk installation
waiver which applies only to the Harbor Passage frontage.
Since the propertytb thi west"bf the above-referenced property does not have a
sidewalk and since this property is not part of a school route and the waiving of
the sidewalk requirement will not create a pedestrian hazard, this location meets
the requirements set forth in Section 138.09. Therefore, a temporary waiver of
the sidewalk requirement along Harbor Passage is granted: Should it be determined
that a sidewalk is required at this location in the future, it will be installed
by the assessment process. The sidewalk along Island Way will be installed as
shown on the revised site plan dated July 7, 1987.

Section~8.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, conunercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees tha~ if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.

SUBJECT: Sidewalk Wai ver Request - 610 Island Way
DATE: August 3, 1987
This property is located on the southwest corner of Island Way and Harbor Passage.
The subject waiver request applies only to the Harbor Passage frontage.
We have discussed the Harbor Passage right-of-way with the Engineering Department
and found that this may become a private street due to a reverter clause. The only
property to the west does not have a sidewalk, this is not part of a school walk
route, and the absence of a sidewalk does not create a pedestrian hazard. ' It is
therefore my recommendation that a waiver be granted for the sidewalk along Harbor
Passage and the sidewalk along Island Way be installed as shown on the revised site
plan dated July 7, 1987.
