A G R E E MEN T
THIS AGREEMENT, Made this 20th day of June, A. D. 195,6, by
and between CLIFFORD LAMB and HELEN LAMB, his wife, of the City of
Clearwater, Pinellas County, Florida, hereinafter referred to as
the "Owners" and the CITY OF CLEARWATER, FLORIDA, a municipal
corporation, hereinafter referred to as the "City",
WHEREIN IT IS MUTUALLY AGREED AND COVENANTED AS FOLLOWS:
That the Owners-,being the Owners of LOTS FIVE ( 5 }-and SIX
(6), BAYSIDE SUBDIVISION #2, according to the map or plat thereof
as recorded in plat book 27, page 32, public records of Pinellas
County, Florida, are hereby granted the privilege of a temporary
connection to the existing City sewer line located on Harnden Drive
in the City of Clearwater; provided, however, that inconsideration
thevefor the Owners hereby covenant and agree that if and when the
City constructs a sewer line and necessary appurtenances thereto to
serve Bayside Subdivision #2, the said Owners will pay their pro-
rata share of the cost of said sewer and appurtenances which mayor
may not include the construction of a lift station and necessary
force mains.
The Owners further agree that all expenses, inspection fees,
and such other charges as are necessary to enable them to connect
to the existing sewer line located on Harnden Drive will be paid by
the Owners and the City shall not be held responsible for any of the
cost thereof.
IN WITNESS WHEREOF, the parties hereto for themselves, their
heirs, assigns and successors hereunto set their hands and seals the
day and year first above written.
