WH~REAS, the: Ovner owns the following describcd real property situated in the
City of Clearwater, P;.1l;:'d~as County, J?lorida, to wit: See Exhibi t 'A" attached

WHEREAS, Section 7 -6 of the Code of Ordinances of the City requires that all 12.nc
that abuts a public right-of-way, which is to have new construction on it, either for resi-
dential, cOlnn1Crcial, industrial or other purposes, shall have sidc\'valks constructed by
the owner on, across or adjacent thereto; and

WHEREA:S" the Owner hac;,- :agreed that ii in the future the City, in its sole discretic:::
determines that iJt is advisable 3.:nd neces sary to have such side-.valks installed, that the
Oymer will, upon notification by,t.ih.e City, have s:idev.ralks immediately installed at his ex-
pense, and if he should fail to de) ,~o then the City rnay have said installation made and ir:-:?:::

NOW, THEREFORE, it: consideration of the foregoing premises and other gooe 2.::C
valuable consideration between e~l,e parties, :receipt of which is hereby acknowledged, the
parties hereto covenant and agree 2lS follows:
1. The City will not at t:'hi.:, tiIne require the installation and construction of
sidewalks as part of the erection' QJ the building and improvements by the Owner on the
above described re;w. property.
2. The CSt"}" may at any t"d:m:~.! in the future notify the Owner, his heirs, per 5 anal
representatives, successors or :lssjgns that the City in its sole discretion hees detenni~ec
that it is advisablre 2nd necessar~,~ te. have sidewalks installed in connection with said
described real propE~rty.

3. The Owne:r or his hebs, personal representatives, successors or assigns S::2~:
at hili expense within ninety (90) clays' from 'the notification by the City have sidewalks 1::-
stalkd for said described real property in accordance v.rith C~~y specifications and sta~c2::-:::
as es')ablished.
4. If the Ownc:r or his heirs, personal representative:::, successors or assigns 5.-:2':
fail to have sichwalks installca for the described real propcrt:- in accordance with City
spccir;cations and standards within ninety (90) days from the rotification by the City,
then the City may have the sidcw"alks installed and assess and ilnpose a lien against the
descri;)ed real property for the cost of the work.
