I Since installation of a sidewalk to align with the one abutting your property on the noxth would result in its destruction when McMullen-Booth Road is widened and a sidewalk installed at the new property line would be of no use to pedes- trians, a temporary waiver of the sidewalk installation requirement is granted on the above-referenced property with the following stipulation: Clearwater 300, Ltd. or the property owner at that time wi 11 install a 5-foot wide sidewalk at the appropriate location (if not constructed as part of the roadway widening project) within 60 days after the widening of the abutting section of McMullen-Booth Road is completed. If this sidewalk is not installed within this 60 days previously mentioned, the City of Clearwater will per- v~ truly f::rfjjation and assess the property owner. ~hOny . Section~8.09 of the Code of Ordinances of the City requires that all land that abuts a public right-of-way, which is to have new construction on it, either for residential, commercial, industrial or other purposes, shall have sidewalks constructed by the Owner on, across or adjacent thereto. The Owner understands and agrees that if the waiver is granted, the City may install sidewalks at a future date and assess the owner for the full cost of said sidewalks. City Manager FROM: Keith Crawford, Traffic Engineering Director COPIES: Andy Onufer, Building Department Director SUBJECT: Sidewalk Waiver Request - 300 McMullen-Booth Road S DATE: January 5, 1987 We have signed for a Certificate of Occupancy for the Laurelwood Pre-School and Child Care Center located at the subject address, conditional upon the granting of a sidewalk waiver with the following stipulation: Upon completion of the widening of McMullen-Booth Road, the property owner will be responsible for the installation of a 5 foot wide sidewalk at the appropriate location along McMullen-Booth Road (if not constructed as part of the roadway widening project). Installation of a sidewalk to match the alignment of existing sidewalk to the north (based on 100 foot right-of-way) would result in removal during the widening of McMullen-Booth Road and installation based on the new proposed right-of-way would be of no use to pedestrians. It is, therefore, my recommendation that a waiver be granted with the above stipulation. ' .t:f:? Attachment
