Dear Ms. Hayes:
In accordance with Section 138.09 of the Code of Ordinances of the City of
Clearwater, I have reviewed your request for a temporary sidewalk installation
. waiver.
Since the sidewalk required to be installed at McMullen-Bboth Road would be
destroyed by the County's widening project, your request for a waiver of the
sidewalk requirement on McMullen-Booth Road only is granted until the completion
of the McMullen-Booth Road widening project. At that time, if the sidewalk has
not been installed by the County and you are unable to produce evidence of your
obligation being transferred contractually to the County, you will be required
to install an 8-foot sidewalk within 180 days.

Sidewalk Waiver Request: 3030 McMullen-Booth Road

The subject property is located on the west side of McMullen-Booth Road north of S.R.
580 and is leased from the City of Clearwater by the Chi Chi Rodriguez Youth Foundation.
We have reviewed the request for a sidewalk waiver and found that a 5~foot wide sidewalk
exists along the west side of McMullen-Booth Road from S.R. 580 northward to the north
property line of Countryside High School. A City of Clearwater parcel which is 120
feet wide lies immediately north of the school property. This parcel has a fenced-in
gas gate station for gas distribution, and sidewalk has not been provided. The subject
leased property lies between the fenced-in parcel and City park property to the north,
which also does not have sidewalk provided.
The installation of an 8 foot wide sidewalk is proposed as part of the McMullen-Booth
widening project. Prel iminary design plans call for the preservation of existing
wetlands on the subject property, resulting in alignment of the sidewalk near the
roadway. Since the sidewalk alignment is dependent upon wetlands design, and jurisdic -
tions such as FDER, USCOE, and SWFWMD are involved, installation of the sidewalk at
this time is impractical. '
It is my recommendation that a sidewalk waiver be granted for the frontage along McMullen-
Booth Road until completion of the road widening project. The ChiChi Rodriguez Youth
Foundation would then have 180 days to install an 8 foot wide sidewalk, if not provided
by the County widening project.
The property frontage along Landmark Drive has an existing 5 foot wide sidewalk provided.
