WITNESSETH:
WHEREAS, the: Ovner owns the following described real property situated in the

WHEREAS, Section 7-6 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, whi.ch is to have new construction on it, either for resi-
dential, comm,ercial, industrial or other purposes, shall have sidewalks constructed by
the owner on, across or adjacent thereto; and
WHEREAS,. -cthc Owner is erecting certain new construction on said prope rty and h2;s
re~p.ested the City cBt this time not ft'!) require the irm:nediate installation and co nstruction
of !i:idewalks in c'm.:mection therewioth; and
WHEREA:S" the Owner haS' :agreed that if in the future the City, in its sole discretion,
determines that :fit IS advisable a:J::J:d necessary to have such sidewalks installed, that the
Owner will, upon notification by,tfu:e City, have sidev,ralks immediately installed at his ex-
pense, and if he should fail to dcrJ ,$(0 then the City may have said installation made and impOSE
a lien against the described real! property for the cost hereof;
NOW, THEREFORE, ir: cnnsideration of the foregoing premises and other good and
valuable consideration between tlh<e parties, receipt of which is hereby acknowledged, the
parties hereto covenant and agr(~ <l.S follows:
1. The City will not at t:fhi.!, titne require the installation and construction of
sid~ewalks as part of the erection' 011 the building and improvements by the Owner on the
above describedre;w. property.
2. The Ci'tymay at any 1i:aJl"t~! in the future notify the Owner, his heirs, personal
representatives, SU:tcessors or :ls.s':igns that the City in its sole discretion has determined
that it is advisab1~ and necessar~,~ tOl have sidewalks installed in connection with said
described real propt:'Tty.

3. The Owner or his hei:!7s" personal representatives, successors or assigns shall
at hi:i expense within ninety (90) clays from the notification by the City have sidevlalks in-
stalled for said described real property in accordance with City specifications and standarc.s
as es~1ablished.

4. If the Owner or his heirs, personal representative;;, successors or assigp.st>Wall
fail to have sid~walks installed for the described real propert-j in accordance with C~ t!
specifkations and standards within ninety (90) days from thc I:otification by the City,'O:t;; ~ ~
