FLORIDA, a municipal corporation, party of the first part, hereinafter
referred to as the "City11, and CHARLES T. BRAMMER and MARTHA J.
BRAMMER, his wife, parties of the second part, hereinafter referred to
as the "Owners I', of the County of Pinellas, State of Florida;
WITNESSETH:
WHEREAS, Charles T. Brammer and Martha J. Brammer, his wife,
are the owners of the following described real property lying and being in
the County of Pinellas, State of Florida, and more particularly described
as follows, to wit:
Begin at the NE corner of the NW 1/4 of the SE 1/4
of Section 13, Township 29 South, Range 15 East and
run thence N 89023111" W, 981. 80 feet; thence S 000
3611111 E, 302.24 feet for a P. O. B. ; thence continue
S 00036'1111 E, 362.29 feet; thence S 89018'16" E,
340.89 feet; thence N 00032'3111 W, 415.01 feet; thence
N 89023'11" W, 118.50 feet; thence S 00032'3111 E, 52.40
feet; thence N 8902014311 W, 222.77 feet to the P. O. B. ;

WHEREAS, said Owners have requested the City to zone a certain
sixty foot (60') strip of his property which was erroneously considered to be
a dedicated street right of way to conform to the zoning of the remainder of
Owner1s property; and
WHEREAS, the City is willing to to zone said strip of real property
provided that the Owners will agree to certain stipulations in reference to
the development of said property;
NOW, THEREFORE, For and in consideration of the sum of One
Dollar and other good and valuable considerations pas sed by and between
the parties, the receipt and sufficiency whereof is hereby acknowledged,
it is hereby agreed by and between the parties with reference to said
property as follows:

1. The Owners agree that in the development of the above described
property Rogers Street will be extended into the property and will be the only
entrance for traffic into the development.
2. The Owners further agree that Canterbury Road will not be opened
to traffic through the development but will be fenced or screened by the Owners
at their cost.
3. The Owners further agree that the cost of all paving and any
other costs involved shall be borne by the developer.
4. All the parties hereto mutually agree that this contract shall be
binding upon the owners, their grantees, their heirs, executors, administrators,
successors and assigns and all parties claiming through them.
