CONSENT AGREEMENT - TO LOCATE AND MAINTAIN A BUSS PASSENGER SHELTER ". ~ e e CONSENT AGREE:ENT alley running Horth and South between Parl{: Street on the S~)Uth and Cleveland street on the North, all in Clearwater, Florida, and WHEREAS the Clearwater Transit Company, a transportation utili ty corp oration, having the franchise to operate busses on the streets of Clearwater, has requested permission of said City to locate and maintain a bus passenger shelter, as hereinafter des- cribed, in a portion of said alley i~ediately south of the side- walk lying on the south side of Cleveland Street, and VJHEHEAS, the following described proper'by lying immediately west of and contiguous to the portion of said alley to be so used is owned by Coachman Properties, Inc., a Florida corporation: East fifty-three (53) feet of the South sixteen and thirty hundredths (16.30) feet of Lot one (1), the East fifty-three (53) feet of Lot two (2), and the East fifty-three (53) feet of the northerly twenty- six (26) feet two (2) inches of Lot three (3), all in Block four (4) of GOULD & EWINGS SECOND ADDIT.rON, as recorded in Plat book 1, page 52 of the ,t)ublic records of Hillsboroush County, Florida, of wIlieh Pinellas County was formerly a part. Coachman and Woolworth hereby consent and agree to ma~e no protest nor enter any objection to any action of City in allowing the installation and maintenance of a bus passenger shelter at the place and in the manner hereinafter described. 2. Said bus passenger shelter shall be approximately 8 x 20 feet in size, located in the center of said alley with the long axis running north and south, and its northern edge approximately even with the northern intersection of said alley with the side- walk lying on the south side of Cleveland Street. 3. Said bus passenger shelter shall be attractively de- sgned and constructed, and maintained in such a manner as not to constitute a nuisance. 4. No vending machines or sales of any kind roall be opera- ted in connection with said shelter, awi its only use shall be as a bus passenger shelter. 5. Coachman and Woolworth hereby agree that said use of said alley is a public one and that they will make no objection to such use now or in the future. Dear Sir: .~ We respectfully request permission to erect an attractive sun and rain shelter for our passengers over the North end of the alley separating McCrory's and Woolworths on Cleveland Street. We also request permission from the City for 100 feet of parking ~ace at this location for use as a central downtovm bus stop and loading space. This plan would provide sun and rain shelter for our patrons, provide one place to load outgoing buses and make it far more convenient for riders to make connections from one line to another. Use of the alley in this manner would eliminate waiting passengers ~rom blocking sidewalks and would place our buses in a central location more convenient to the public.
