AGREEMENT
THIS LEASE, made this :L ?u(

between the CITY OF CLEARWATER, Florida,
existing under the laws of the State of Florida, hereinafter called the Lessor,
and CLEARWATER FIRE FIGHTERS ASSOCIATION, I.A.F.F., a non-profit
corporation organized under the laws of the State of Florida, hereinafter
called the Les see;
WITNESSETH:
That in cons ideration of the covenants herein contained on the part of
the Lessee to be kept and performed, the said Lessor does hereby lease to
the said Lessee the following described property located in PinellasCounty,
Florida, to wit:
The West 1/2 of Lots 17 & 18, Sue Barco Subdivision as
recorded in Plat Book 1, Page 26 of Public Records of
Pinellas County, Florida, also known as 306 & 306 1/2
Seminole Street, Clearwater, Florida,
TO HA VE AND TO HOLD the same for the term of twenty-five (25)
years commencing October 1, 1974. Said Lessee shall pay therefor the
rental of One Dollar ($1. 00) per year which said rental shall be due and
payable on or before October 1 of each and every year of said term.
The Lessee hereby covenants and agrees to make no unlawful,
improper or offensive use of said premises; not to assign this lease
nor to sublet all or any portion of the demised premises without the
written consent of the Lessor; and to use the premises during the term
only for as sociation functions and related bus ines s.
The Lessee hereby further covenants to save the Lessor harmless
from any and all claims for injury and damage that may arise from any and
all activities and uses of the premises whether or not said activities and
uses are legal or authorized by this lease; the Lessee shall keep and
maintain proper and adequate fire and public liability insurance during
the term of this lease, which said insurance shall list the Lessor as an
additional insured under said policy and Lessee shall obtain and deliver

to the Lessor a certiJcate of insurance showing SUchlCOVerage.
The Lessee
further covenants to keep and maintain the premises in a good, safe, neat
and attractive condition during the term hereof, and to promptly deliver
up the premises upon the expiration of the term of this lease.
The Lessee hereby covenants and agrees during the term of this
lease to pay to the proper public authorities all ad valorem, real and
personal property taxes and license fees levied and imposed on the leased
premis es or upon the pers onal property located in and the bus ines s conducted
on the demised premises prior to the date upon which payment of the same
would be delinquent including taxes of the City of Clearwater; provided,
however, that the Lessee shall have been presented with bills therefor,
and provided further that nothing herein contained shall obligate Les s ee to
payor to reimburse Lessor for the payment of any such assessment for
permanent improvements or betterments, such as sidewalks or sewers
or other improvements or betterments or to reimburse Lessor for any
portion of any tax not allocable to the term of this leas e.
That the Lessee will cooperate with the Lessor in making the facilities
accessable to other City employee groups insofar as it does not interfere
with the normal functions and activities of the Lessee.
The Lessee hereby covenants to pay all bills for electric current,
gas, heat and other services to the premises requested by the Lessee within
ten (10) days after each of said bills shall have been rendered.
In the event the Lessor retains an attorney to enforce any of the
provisions of this lease, or renewals of or addenda to this lease, or to
effect the enforcement of any legal right of Lessor against the Lessee,
the Lessee hereby agrees to pay to the Lessor all costs of said enforcement
including court costs and reasonable attorney's fees.
Les sor may at any time during the term of this leas e terminate this
lease for any valid municipal purpose by giving to the Lessee thirty (30)
days' written notice of termination. In the event said leas e is terminated
prior to its expiration by the City as herein provided, Lessee shall be
refunded the then reasonable value of all improvements made by it upon
said premis es during the term of this leas e. The parties hereto mutually

covenant and agree thlt Lessee shall not make any addlt ional improvements
upon the premises during the term of this lease without first obtaining the
written consent of the City Manager of the City of Clearwater.
IN WITNESS WHEREOF, the parties hereto have set their hands and
