A G R E E MEN T
This is an agreement entered into between the City of Clearwater and the
Caribbean Gulf Island Resort, 430 Gulfview Boulevard, South, Clearwater
Beach, for police directed patrol services, beyond the al10ted and budgeted
time of such service, as provided by the City of Clearwater.
The City of Clearwater agrees to:
1. provide extended "directed patrol" service to those public areas
in the immediate area of the Caribbean Gulf Island Resort, to
include the public parking lots and beach area adjacent thereto,
said "directed patrol" to be conducted exclusively and con-
.
tinuously in the immediate environs of the Caribbean Gulf except
in the case of any unexpected emergency requiring an immediate
police response, at which time the officers shall respond as
directed to the emergency and return to "directed patrol"
service as promptly as practicable.
2. provide for the extension of "directed patrol" service from
1:00 am to 3:00 am, or in such other two hour increments as
requested by the Caribbean Gulf and agreed to by the Police
Department.
3. indemnify and hold harmless the Caribbean Gulf from any lia-
bility arising from the actions and conduct of any officer of
the Clearwater Police Department assigned to "directed patrol".
4. schedule, supervise and be responsible for administrative services
for all city police personnel assigned to this service.
The Caribbean Gulf Island Resort agrees to:
1. reimburse the City of Clearwater the costs for providing the
extended directed patrol service for the requested time and in
accordance with the attached rate schedule.
2. pay within a period of fifteen (15) days each invoice received from
the City of Clearwater for the above described extended services.
This AGREEMENT entered into on bJA.teJ! ~y. Ifr~ and will continue, as
requested and scheduled, until one or both parties desire to terminate
this agreement or until the need for described services diminish.

User Fee Agreement - Caribbean Gulf Hotel

{,:;u will recall that at the Corrunission Work Session of March 14th, I
presented an update to the corrunission regarding problems associated
with the 2:00 A.M. closure of Jack's Place in the Caribbean Gulf
Hotel, and the impact it was creating regarding the congregation of
large groups of persons and noise problems in the extreme southern
portion of the South Gulfview Parking Lot. I informed the Corrunission
at that time that I would contact officials of the Caribbean Gulf Hotel
to attempt to work out a solution to this problem.
On March 25th, I discussed this matter with you and informed you that I
had contacted Jon Carrington, General Manager of the Caribbean Gulf
Hotel and that we had mutually arrived at a solution to the problem.
Specifically, implementation of a user fee that would provide for an
extension of our directed Beach Patrol Program between the hours of
1:00 A.M. ~ 3:00 A.M. on Friday, Saturday and Sunday evenings when this
problem occurs.
Acting on your authorization to proceed with the user fee conceptI a
written agreement (copy attached) was developed and subsequently reviewed
by Attorneys for the City and the Caribbean Gulf Hotel. This agreement
will provide for the assignment of two officers between the hours of
1:00 A.M. - 3:00 A.M. in the South Gulfview Lot who will be paid by the
City at their overtime rate. The Caribbean Gulf will in turn reimburse
the City in accordance with the fee schedule included in the attached
agreement.
This User Fee Agreement will accomplish several things. First, it will
provide for the utilization of sworn officers having arrest authority in
the parking lot, it will supplement our directed Beach Patrol Program by
extending the hours of operation on those nights that we experience the
highest level of activity, and the hourly rate of the overtime costs
charged to the Caribbean Gulf Hotel would help offset some of the
original costs of the City's directed Beach Patrol Program.
As it was purposely established, the agreement allows the Caribbean Gulf
to request this service from the City on a week-by-week basis and they
hiwe initially' requested that we provide this service fora six-week
period starting Friday, April 1st and ending Sunday, May 8th. The
payment from the Caribbean Gulf will be credited to the Police
Department's budget account for overtime costs within the Patrol Division.
I would appreciate it if you would bring this information to the attention
of the Corrunission.
