CONSENT OF MORTGAGEE TO DECLARATION ON CONDOMINIUM FOR THE STATION SQUARE CONDOMINIUMS CONSENT OF MORTGAGEE TO DECLARATION OF CONDOMINIUM FOR THE STATION SQUARE CONDOMINIUMS, A CONDOMINIUM THE CONSENT is given as of the ~dayof OGh>ber , 2~o4- on behalf of COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF CLEARWATER, FLORIDA ("Mortgagee"), being the owner and holder of that certain mortgage made by ST A nON SQUARE, LLC, a Florida limited liability company ("Mortgagor"), dated the 29th day of August, 2004, and recorded in Official Record Book 13791, page 2113, of the Public Records of Pinellas County, Florida, has been or may be amended from time to time ("Mortgage"). WHEREAS, Developer has requested Mortgagee to consent to the recording of the Declaration of Station Square Condominiums, a Condominium (the "Declaration"). NOW, THEREFORE, Mortgagee consents to the recordation of the Declaration. Mortgagee makes no warranty or nay representation of any kind or nature concerning the Declaration, any of its or their terms or provisions, or the legal sufficiency thereof, and disavows any such warranty or representation as well as any participation in the development of Station Square Condominiums, a Condominium (the "Condominium"), and does not assume and shall not be responsible for any of the obligations or liabilities of the developer contained in the Declaration or the prospectus, (if any) or other documents shall be deemed to have been made by Mortgagee, nor shall they be construed to create any obligation on Mortgagee to any person relying thereon. This consent is limited to the purposes and requirements of Sections 718.104 and 718.403, Florida Statutes, and does not affect or impair the rights and remedies of Mortgagee as set forth in the Mortgage or in the Declaration.
