EXHIBIT "C" TO
APPLICATION FOR ZONING ATLAS AMENDMENT
The subject property consists of approximately 2.90 acres and is currently developed with J:etftil
uses. The property was included in the Settlement Agreement between U.S. Steel and City of
Clearwater, dated October 17, 1986, No. 78-4765-7- and amended Febtua1'Y 4, 1987~No. 83-
14905-7 (!1Settlement Agreement!1). Per the terms of the agreement, the Settlement Agreement
expired October 17,2006. The property was developed in accordance with Sections 12_ 16 of
the Settlement Agreement and accordingly, retained a zoning of Business (8). This.ning
district no longer exists and therefore the property is currently not zoned. The land use
designation of the property is Resort Facilities High (RFH). The Applicant reque$ts rczoloil1lg to
Tourist in order to zone the property consistent with its existing use and cOmpatible with tile
existing land use designation.
Standards:
1. The proposed amendment is consistent with and furthers the loal$~...lit_ a.i.
objectives of the Comprehensive Plan and furthers the purposes oftheCo..,.ity
Development Code and other City ordinances and actions design. toi.pl_..Dt
the Plan.
The Tourist zoning category allows the existing uses of the property to eonfOl'11lto Code
and is reflective of the traditional use of these parcels. Retail shops have*rated atthi.
location since their construction in 1989. The requested Tourist zolling distriet is
compatible with the existing land use designation of Resort Facilities High.
The Comprehensive Plan designates land use elements which enc()'t.U:agethereuwlIllof
the beach tourist district (Policy 2.1.2) and mixed use development (Obj. 2.,2).
The Plan provides for the ResOlt Facilities High land use designation to bep_d with
zoning categories of High Density Residential, Tourist, or Commc=rcial(policy 3.2.1).
This proposed rezoning reflects the actual use of the site and is eompatiblewith th.e
current land use.
2. The available uses to which the property may be put are appropriate to the property
that is subject to the proposed amendment and compatible with exilllnl aDd
planned uses in the area.
The current uses have been in existence at this location for 18 years. and are compatible
with the other residential and tourist uses on Sand Key.
3. The amendment does not conflict with the needs and character of then......
and the City.
The amendment will not impact the current uses, which are compatible with th.e
neighborhood. The current use provides retail and restaurant as well as a hotel. 'l1!J.e
property is located at the northeast end of Sand Key, just south ()fthe
area owned by the City of Clearwater. To the south of the property
development. The uses across Gulf Boulevard from the property ate It
and high- rise condominiums.
4. The amendment will not adversely or unreasoDahle affect the use of other property
in the area.
The rezoning will not have an adverse effect on any of the exis.g
neighboring properties.
