Dear Ream:
In accordance with Section 133.0Q of the Code of Ordinances of the City of
Clearwater, I have reviewed your requests for temporary sidewalk installa-
tion waivers.
1. Bayview Avenue--A temporary sidewalk installation waiver is granted~
for Bayview Avenue in that'this right-of-way is unimproved and there
are no sidewalks within 200 feet.
2. Drew Street--A temporary sidewalk installation waiver is grantedl for
this right-of-way in that it is unimproved and there are no sidewalks
within 200 feet. Also, Drew Street will be extended to McMullen-Booth
Road by the City of Clearwater as a top priority item when the extra
dollars from the anticipated gasoline tax are received. The right-of-
way for Drew Street is such that sidewalks constructed prior to the
anticipated extension are liahle to be damaged during the street
improvements.
3. McMullen-Booth Road--A temporary sidewalk installation waiver is
granted\for this right-of-way in that it is unimproved arid there
are no sidewalks within 200 feet. This right-of-way is similar
to the situation which exists on Drew Street in that Pinellas County
intends to widen Mdfullen-Booth Road from Sunset Point Road South
when additional revenue is received from the new gasoline tax.

Should slippage occur in the County's plan, this sidewalk will need to
be installed because it is a route leading to a public park and the
absence of a sidewalk may create a pedestrian hazard because of the
recreational complex adjacent to it.

Section 133.09 of the Code of Ordinances of the City requ~res that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The OWner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of

I have examined the area of McMullen-Booth Road near the Eddie Moore Recreation
Complex and found that there are no sidewalks within 200' of this property. Since
the conditions established in the Ordinance for a waiver are met it is my recommen-
dation that a waiver be granted. .
