A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, APPOINTING THE CITY COMMISSION OF THE CITY OF CLEARWATER AS THE COMMUNITY REDEVELOP MENT AGENCY UNDER FLORIDA STATUTES, CHAPTER 163. - WHEREAS, the City of Clearwater has found by Resolution 81-67 that a blighted area exists within specific boundaries in and around the central downtown business district in the City of Clear- wa ter; and WHEREAS, the City of Clearwater has found by Resolution 81-67 that rehabilitation, conservation, or redevelopment, or comb- ination thereof, of the blighted area is necessary in the interest of the public health, safety, morals, or welfare of the residents of Clearwater; and WHEREAS, the City of Clearwater has found by Resolution 81-67. that the establishment of a Community Redevelopment Agency under .Florida Statutes, Chapter 163, is necessary to' carry out activities to ameliorate conditions in the blighted area; and WHEREAS, by Resolution 81-466 the County of Pinellas de- legated the pow~r and authority to. the City Commission of the Ci ty of Clearw'ater to act as t..~e Communi ty Redevelcpmen t Agency under Florida Statutes, Chapter 163; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEAro~ATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: 1. That the City Commission of the City of Clearwater is declared to be the Community Redevelopme~t Agency under Florida Statutes, Chapter 163. 2. That wh~n acting as the Community Redevelopment Agency the Commission is acting as a public body corporate and politic, separately and distinctly from its actions as the City Commission. 3. Tha t the C.i ty Commis s ion acting as the Co nununi ty ~ff ,;J ,:'~ ~~....~ .,' # lI" ~- : ,- . I I . - ..~;. Redevelopment agency shall have the following redevelopment powe rs : a. Power to find and declare blighted or slum areas within the Downtown Development District area; b. Powe~ to find and de~lari the necessity of rehab- ilitation, conservation and/or redevelopment of . said area; c. Power to create the operational basis including funding thereof for the City of Clearwater City Council acting as the redevelopment agency for the Downtown Development District area; d. Power to prepare, adopt and modify the redevelop- ment plan, subject to approval of the Board of County Commissioners of Pinellas County; e. Power to create the redevelopment trust fund and execute,including issuance of revenue bonds, all funding considerations thereunder, subject to approval by the Board of County Commissioners of Pinellas County; and f. Power for the redevelopment agency to exercise eminent domain and to acquire, lease, and dispose of property. 4. That, in accordance with Resolution 81-466 of the Board of County Commissioners, the .following exercises of authori ty are hereby reserved to the Board of County eommissioners. a~ Review and approval of the initial redevelopment plan prior to its effectuation and also prior to presen ta tion to the Pinellas Pla.J.ning Cotlllcil; and b. Review and approv~~ of the creation,operational basis and debt service structure of the redevelop- ment trust fund prior to its effectuation. 5. I ,I ' , ,I WHEREAS, there exists a specifically bounded area in and around the central downtown business district described in Exhi.bi,t, A; and WHEREAS, the County of Pinellas by Resolution 81-466 has delegated certain community development powers and authority under Florida Statutes, Chapter 163, within the aforementioned specif- ically bounded area to the City Commission of the City of Clearwater; and WHEREAS, there is a predominance of defective or inadequate street layout by modern standards in this area; and lffiEREAS, there is faulty lot layout limiting the nature and extent of uses of properties in the area; and WHEREAS, there is deterioration of sites, buildings, and other improvements in this area; and WHEREAS, there is diversity of ownership within the area which prevents the free alienability of economically feasibly- sized properties; and WHEREAS, there are unusual conditions of title based on large institutional holdings in this area which restrict the market supply and size of private enterprise land; and " I WHEREAS, there is a static tax base, with conditions of ownership which portend a continuing relative decline in the downtown area's values; and WHEREAS, the City Planning Department has prepared a report which documents the aforementioned blight conditions; ,I ' NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO~~1ISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: L I ~:' I 'I lJ," " ,,, 'I' I' I ~,I I" , ~; +' II !'
