RESOLUTON 81-45 FOR REQUESTING A DELEGATION FOR CONDUCTING A COMMUNITY REDEVELOPMENT PROJECT . . 1 I .- RESOLUTION \ No. 81 . 45 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, REQUESTING A DELEGATION OF AUTHORITY FROM THE PINELLAS COUNTY COMMISSION PURSUANT TO SECTION 163.410, FLORIDA STATUTES. WHEREAS, che City of Clearwater, Florida, proposes to conduct a Community Redevelopment Project in the City of ~learwater Downtown De- velopment District pursuant to Part III of Chapter 163, Florida Statutes; and WHEREAS, Section 163.410 of Chapter 163 Florida Statutes, requires a municipality to obtain a delegation of authority from the governing body of a home rule charter county prior to exercising the powers conferred under this Chapter; and WHEREAS, Pinellas County is a home rule charter county and the Board of Courtty Commissioners of Pinellas County is empowered to delegate to the City such authority under Chapter 163, Part III as they may choose to enumerate by resolution; and rN~EREAS, the Plan for Downtown Clearwater encompassed within the City of Clearwater Comprehensive Land Use Plan has been adopted; and rN~EREAS, such Plan calls for redevelopment of the Downtown Deve looment District described in the Plan; a map and legal d~scription of which Downtown Development District is attached as Exhibit A and made a part of this reso lution; and w~EREAS, the City Commission of the City of Clearwater in order to commence the Redevelopment Project desires' to request t:he Pinellas County Commission " . t'. ..' .'... . . . delegate to the City of Clearwater all those powers set out in ?art III of Chapter 163, said delegation to be made pursuant to Section 163.410, Florida Statutes; and ;}h -l- "J J:'" /) i. ~<. l.' ,-. WHEREAS, the City Commission recognizes the valid interest of Pine lIas County in the redevelopment project and is agreeable to providing for Board of County Commissioners review and approval of the redevelopment plan and the funding considerations related to the accomplishment of the plan through the establishment of the redevelopment trust fund; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: 1. That the City Commission of the City of Clearwater, pursuant to Section 163.410, Florida Statutes, hereby requests the Pinellas County Com- mission to delegate the following power as being necessary to conduct a Com- munity Redevelopment Project in the City of Clearwater, Florida, in the Downtown Development District identified on Exhibit A: a) Power to find and declare blighted or slum area; b) Power to find and declare the necessity of rehabilitation, con- servation and/or redevelopment of said area; c) Power to make a finding and declaration that a community development agency is necessary; d) Power to establish and appoint members to a community redevelopment agency; e) Power to create the operational basis for the redevelopment agency including funding thereof; f) Power to prepare, adopt and modify the redevelopment plan; g) Power to create the redevelopment trust fund and execute all funding considerations thereunder including issuance of revenue bonds, and h) Power for t~e redevelopment agency to exerCIse eminent domain and to acquire, lease and dispose of property. 2. That the City Commission in requesting, and the Board of County Commissioners in authorizing, the delegation of authority above set forth mutually agree that the delegation of authority shall include provision for: a) Pinellas County Commission review and approval of the initial redevelopment plan prior to its effectuation; and - 2- ,x;- . , " . -' 1 J . b) Pinel1as County Commission review and approval of the creation, . . operational basis and debt serv1ce structure of the redevelopment trust fund prior to its effectuation. 3. SAMPLE COUNTY RESOLUTION I . r I RESOLUTION DELEGATING AUTHORITY AND POWERS CONFERRED UPON PINELLAS COUNTY THROUGH THE COMMUNITY REDEVELOPMENT ACT OF 1969, CHAPTER 163, PART III, TO THE CITY OF ST. PETERSBURG CITY COUNCIL FOR THE REDEVELOPMENT OF THE IDDP CORE, WEBB'S CITY AND GAS PLANT AREA; THE CITY OF CLEARWATER CITY COMMISSION FOR THE REDEVELOPMENT OF THE DOWNTOWN DEVELOPMENT DISTRICT, AND PROVIDING AN EFFECTIVE DATE: WHEREA~, the Legislature of Florida enacted the Community Redevelopment Act of 1969 as amended; and WHEREAS, all powers arising through the aforesaid enactment were conferred by that enactment upon counties with home rule charters, which counties in turn are authorized to delegate such powers to municipalities within their boundaries when such municipalities wish to undertake redevelopment projects within their respective municipal boundaries; and WHEREAS, such authorization for counties to delegate such powers to municipalities is contained in Section 163.410, Florida Statutes, which states: "163.410 Exercise of powers in counties with home rule charters.--In counties which have adopted home rule charters, the powers conferred by this part shall be exercised exclus- ively by the governing body of such county. However, the governing body of any such county which has adopted a home rule charter may, in its discretion, by resolution delegate the exercise of the powers conferred upon said county by this part within the boundaries of a municipality to the governing body of such a municipality. Such a delegation to a munici- pality shall confer only such powers upon a municipality as shall be specifically enumerated in the delegating resolution. Any power not specifically delegated shall be reserved exclu- sively to the governing body of the county." WHEREAS, the County and the Cities of St. Petersburg and Clearwater desire to increase the tax base of the respective Cities and County; and WHEREAS, the County and the Cities of St. Petersburg and Clearwater find that delegation of Chapter 163. Part III redevelopment powers and authority to the respective Cities is an appropriate vehicle with which to accompl~h redevelopment in the designated areas; . I 1 .
