RESOLUTION 85-24 FOR PURPOSE OF TRANSFER OF A PORTION OF THE CLEARWATER PARKING SYSTEM AND TERMS OF DISPOSITION " . , I . RES 0 L UTI 0 N No. 85 - 24 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: DECLARING A VALID PUBLIC PURPOSE FOR THE TRANSFER OF A PORTION OF THE CLEARWATER PARKING SYSTEM AND ESTABLISHING THE TERMS OF DISPOSITION. WHEREAS, the City Commission of the City of Clearwater, Florida by Resolution #84-47 authorized the disposition of Lot 3 of the Clearwater Parking System to the Clearwater Redevelopment Agency upon terms to be determined by future supplemental resolution, and WHEREAS, the Agency has agreed to sell a portion of the air rights over said lot for development as a private parking garage and to construct a 204 space parking garage on the land below those air rights, and WHEREAS, the underlying land and parking garage will revert to the City of Clearwater upon payment of the debt to be incurred to develop that .garage and to acquire the property for the Clearwater Square Project, and WHEREAS, the City Commission has held a public hearing to determine if a valid public purpose exists for this property disposition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: 1. The City Commission of the City of Clearwater, Florida hereby finds, determines and declares that a valid public purpose will be served by transfer of Parking Lot 3 of the Clearwater parking system to the Clearwater Redevelopment Agency, towit~ the redevelopment of the downtown area which has been declared blighted and the enhancement of the Clearwater tax base pursuant to Chapter 163, Florida Statutes, together.with the fin- ancing and construction of a 204 space public parking garage. 2. The sale of said lot, more particularly described as follows: Lots 1, 2, 3, 12, 13, and 14 in Block 6 of MAGNOLIA PARK, according to the plat thereof recorded in Plat Book 1, page 70 of the Public Records of Hillsborough County, of which Pinellas County was formerly a part, together with former right-of-way of the Atlantic Coast Line Railroad adjoining said block on the West. to the Clearwater Redevelopment Agency for the sum of $10.00 is hereby authorized. 2/-0 J(_ Co ) 7,- I I (~~1 ,:1 . I I . 3. The proceeds of sale shall be placed in the City of Clearwater Parking System Renewal & Replacement Fund. 4. This Resolution shall become effective immediately upon its adoption.
