AGREEMENT
THIS AGREEMENT, made and entered into this / 2#~ay of

SCHOOL AND KINDERGAR TEN, INC., hereinafter referred to as "School",
and the CITY OF CLEARWA TER, FLORIDA, a municipal corporation,
hereinafter referred to as "City";
WITNESSETH:
WHEREAS, the School performs day care services to children ages
two through kindergarten from low income families living in the City of
Clearwater; and
WHEREAS, the School desires to improve the condition of its playground
area by installing a system of underground drainage and by filling, grading
and sodding the land, and by installing a covered playhouse; and
WHEREAS, the School has petitioned the City for funds to pay for the
proposed improvements; and
WHEREAS, the City has the authority to disburse funds under the Federal
Revenue Sharing Funding Program; and
WHEREAS, the City has determined that the School's proposed improve-
ments are properly funded under the Federal Revenue Sharing Program;
NOW, THEREFORE, in consideration of the foregoing, the parties
hereto, for and.in consideration of the mutual covenants herein made and the
benefits flowing from each party to the other, do hereby agree as follows:
1. The City agrees as follows:
A. To provide drainage plans to the School which plans are anticipated
to improve the playground area, but by providing such plans, the City does not
guarantee that these plans will provide a drainage system that will remedy the
drainage problem of the School or that the plans will improve the playground
area of the School and the City specifically disclaims all warranties which
might be implied by the providing of these plans.

B. To give to the School $2,800.00 toward its proposed project
which includes an underground drainage system, the filling, grading and sodding
of land, and a covered playhouse and $725.00 to the School for payment of
the sewer tap and impact fees to be imposed upon the proposed construction
pursuant to ordinance.
2. The School agrees as follows:
A. To comply with the following applicable administrative require-
ments to be met by agencies receiving funding from Federal Revenue Sharing
monie s through a contract with the City:
I. Records of the School to be accessible to City staff and the
public according to Florida Public Document law.
II. Information to be made available to the City upon request.
III. Board members and Executive Director are required to
submit financial disclosure forms.
IV. To submit a report at the completion of the project outlining
the work performed and the application of funds received from the City.
3. The City and the School mutually agree as follows:
A. The City agrees to issue its check in the amount of $2,800.00
made payable to the School and to the contractor employed by the School at
the completion of the project or at the time all of the administrative require-
ments outlined in section 2A of this Agreement have been satisfied, whichever
is later, and the School agrees to use these funds to pay its contractor for the
performance of the proposed work.
B. The parties understand and agree that this grant is a one-time
project grant.
C. The City agrees to issue its check in the amount of $725.00 made
payable to the School and the School agrees to pay that check to the City of
Clearwater for the payment of sewer tap and impact fees.

D. The City has made no warranties in the design and submission
of its drainage plans and the School accepts the drainage plans understanding
that there are no warranties either stated or implied as to the plans.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement
the day and year first above written.
