SECOND AMENDMENT TO AGREEMENT
THIS SECOND AMENDMENT TO AGREEMENT is made and entered into this

day of ~ , 1992, by and between the CITY OF CLEARWATER,
FLORIDA, a~unicipal corporation, (the "City"), and CLEARWATER SHUFFLEBOARD CLUB,
a Florida nonprofit corporation, located in Clearwater, Florida, (the "Club"),
amending the Agreement between the parties dated October 22, 1987, as amended on
July 14,1989 (the "Agreement").
WHEREAS, the City owns the Clearwater Shuffleboard property (the
"Property") in the City of Clearwater, which Property is used by the Club; and
WHEREAS, the Club has previously installed improvements to the thirteen
shuffleboard courts (the "facil ity"), and now desires to install further
improvements to the facility as described herein; now therefore,
In consideration of the premises and of the faithful performance by each
of the parties of the covenants and agreements between each other made, it is
mutually agreed that the Agreement is hereby amended as follows:
1. Paragraphs 1 and 2 are amended to read:
1. The Club may replace the roof canopies CORstr~ct a roof
canopy over 39 outdoor thirtccn shuffleboard courts at the Property,
and may install siaing cORsistin~ of sliain~ ~lass winaows or Boors
arol:lna tl:1c roof canElJ3Y, according to plans and specifications
approved by the City, and upon completion of the canopy and siding
improvements the Club shall continue to have a license to use the
facility according to the provisions of this Agreement as amended
and the prior Agreement between the parties dated July 24, 1981,
which shall continue in full force and effect.
2. Followina review and approval of construction plans. the
Citv will pav a cash donation of $12.500 and will lend $7.500
interest free to the Club. said loan beina added to the unpaid
principle balance of the loans previouslv made bv the Citv to the
Club. The Club shall continue pavina the loans to the citv in
annual pavments of $2.500 on or before September 1 of each vear.
with the final pavment now beina due on September 1. 1999.
In addition. the Club shall also supplv approximatelv $6.000 in cash
toward the canopv project. as necessarv to pav the balance of the
actual costs of the work to be performed.

2. All of the terms and conditions of the Agreement which are not
expressly amended herein shall continue in full force and effect, and are
