THIS AGREEMENT, made and entered into this 91 FLORIDA, a municipal corporation, hereinafter referred to as "City", and , A.D., 1981, by and between the CITY OF CLEARWATER, the CLEARWATER SHUFFLEBOARD CLUB, INC., hereinafter referred to as "Club"; WIT N E SSE T H WHEREAS, the City owns a piece of property North of Calumet Street and East of Alternate 19 described as follows: (Legal Description) Lots 21-64 inclusive, Block A, all of Block B, All of Block C, Vacated Apache Trail, and Vacated Laguna Street, Navajo Park Subdivision as recorded in Plat Book 7, Page 31 of the Public Records of Pinellas County, Florida, and the upland portion of Lot 4, of J. B. Tenney Subdivision as recorded in Hillsborough Deeds S, Page 96 of the Public, Records of Hillsborough County, of which Pinellas was once a part. Less and except any submerged land. WHEREAS, the City has constructed a Shuffleboard Complex consist- ing of 52 courts, recreation building, and parking lot on the above referenced property; and WHEREAS, the Club has expertise in organizing, developing, and sustaining a quality shuffleboard program; and WHEREAS, the Club is desirous of assisting the City by providing members or personnel to maintain, supervise, and operate this facility; NOW, THEREFORE, IN CONSIDERATION OF THE COVENANTS herein con- tained and other good and valuable consideration, the City hereby agrees to permit the Club to operate the shuffleboard facilities under the following conditions and provisions, to wit: "-, 1. ft, --i , 1981, and the Agreement shall commence ~~i , o - shall continua until a thirty (3 ) day notica The term of of termination in writing is given to either party by the other. 2. The City agrees to purchase wax for the courts and to provide for structural and landscape maintenance to keep the facilities in a state of good repair. 3. The City agrees to pay all utility costs, excluding telephone, and other operating and capital costs as deemed appropriate by the Club and Parks and Recreation Department. ( t., /', ,r) .i /c ~~f. The Cltb, subject to the approval of t~ Parks and Recre- ation Department, shall have the right to establish rules and regu- lations governing the use of courts and the clubhouse, to charge reasonable user fees and club dues, and to conduct other appropriate fund-raising events. Revenues shall be retained by Club to cover expenses hereinafter described. 5. The Club will be responsible for the daily custodial mainten- ance of the facilities and will hire an individual to keep them in a presentable state at all times. The City will budget $lOO.OO/month and remit same to the Club to assist with this expense. 6. The Club shall keep the courts in good playing condition and shall sweep and bead the courts when necessary to provide these con- di tions. 7. The Club agrees to provide all building furniture and all equipment, such as discs, cues, chalk, erasers, etc. to be used by participants. 8. The Club agrees to hire an individual to staff the facilities during regular advertised houors in order for citizens to take advantage of the courts. 9. The Club Agrees that its Board of Directors shall receive no renumeration from the City for managing the Club. 10. The Club agrees to maintain complete financial records of all income and expenditures and to submit to the Parks and Recreation Department seasonal or monthly financial statements and an itemized annual financial statement by March 15th of each year during the life of this agreement. Financial records of the Club shall be made available to City audit'upon request. 11. The Clearwater Shuffleboard Club, Inc. offers all persons the benefits of participating in each of the programs regardless of race, color, religion, sex, national origin, age, handicapped or other non- merit factors. 12. The Club agrees to obtain and keep in force during the term of this Agreement a liability and property damage insurance policy covering said facilities with minimum limits of $500,000 combined single limit Bodily Injury and Property Damage per occurrence, with said policy naming the City as an additional insured. A copy of said policy shall be furnished to the City Clerk of the City of Clearwater. Page Two !. 13. All notice! hereunder shall be sent to the Jity of Clearwater '. City Manager, P.O. Box 4748, Clearwater, Florida, 33518, and to the President of the Clearwater Shuffleboard Club, Inc., 1020 Calumet Street, Clearwater, Florida, 33515.
