PARKING MANAGEMENT AGREEMENT
THIS AGREEMENT made and entered into this /~ day of

1988, by and between the CITY OF CLEARWATER,
FLORIDA, a municipal corporation, hereinafter called "City", and
the CLEARWATER HIGH SCHOOL BAND BOOSTERS, INC., a Florida corpor-
ation not for profit, hereinafter called "Boosters";
WIT N E SSE T H:
WHEREAS, the City desires to provide public parking for the
spring training games conducted by the Philadelphia "Phillies" at
Jack Russell Stadium;' and
WHEREAS, the Boosters are willing to manage said public
parking as a service and fund raising activity; and
WHEREAS, the City desires to cooperate in such arrangement
with the Boosters during the year 1988;
NOW, THEREFORE, The Parties Hereto Do Mutally Agree As
Follows:
1. The City, for the purpose of public parking, will make
available the following stadium parking lot and additional lots:
The stadium parking lot located between Phillies Drive
on the East, Greenwood Avenue on the West, Seminole
Street on the South, and Palmetto Street on the North.

On Green Field located between Greenwood and
Pennsylvania Avenues and bounded by Palmetto Street
on the North and private property on the South.
Public parking will be permitted on the Green Field location only
after the other two lots are filled, provided that at no time
will parking be permitted within the fenced-in softball field
area located at Green Field.
2. The Boosters agree to be responsible for the orderly
parking of all vehicles in each of the designated lots. The
Boosters agree to coordinate all parking with the Clearwater
Police Department to the end that an orderly flow of traffic is

established in and around Jack Russell Stadium.
To facilitate
orderly parking at the Stadiumt the Boosters shall hire two (2)
off duty policement stripe the parking lots to assure maximum
parking arrangementst and shall retaint if possiblet a sufficient
number of Booster volunteers as deemed necessary to reduce or
eliminate the illegal parking of vehicles after each game begins.
The CitYt through its Police Departmentt will provide sufficient
police patrols to further assist the Boosters in the orderly flow
of traffic and parking around the Stadium.
3. This Agreement shall commence with the first home game of
the 1988 spring training season by the Philadelphia "Phillies"
and shall terminate following the eighth home game of that spring
training season.
4. The Boosters are authorized to charge One Dollar ($1.00
$.94 plus $.06 sales tax) per each automobile parked at the
designated parking facilities described in Paragraph One (1).
From the gross revenues collected at each parking site the
following division is to be made:
Six percent (6%) of the gross
revenue shall be remitted to the City for payment of State sales
taxt sixty percent (60%) of the remaining revenues may be
retained by the Boosters and forty percent (40%) shall be
remitted to the City.
Within thirty (30) days following the end
of the seasont the Boosters shall provide the City a final report
of all receipts collected for each game at each of the lots and
at the same time remit to the City a draft or check covering the
total percentage payments described herein.
The Boosters shall
include in its report an accounting for the number of cars parked
by use of prenumbered ticketst listing first and last ticket
numbers for each lot and for each game.
5. As part of their management functiont the Boosters agree
to hold in reserve fifty (50) parking spaces fronting on Stadium
Drive in the first row directly across from the ticket office
extending from Seminole to Palmetto Streetst which spaces shall
be free and for the use of officialst playerst members of the
presst visiting officials and groundskeepers.

spaces shall be provided, by the City or by the Phillies, an
identification sticker which shall be displayed on the vehicle.
6. It is understood that the Boosters presently have in
force a liability insurance policy which would apply to the
activities proposed in this Agreement.
The Boosters shall
provide satisfactory evidence to the City prior to the start of
the first game that it presently has in force a liability
insurance policy naming the City as an additional insured for all
personal injury and property damage claims that might arise
during the term of this Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement as of the date first above written.
