PARKING MANAGEMENT AGREEMENT/PHILLIES (9) I I PARKING MANAGEMENT AGREEMENT THIS AGREEMENT made and entered into this ~ day of FEB~R. Y , A.D. 198~, by and between the CITY OF CLEARWATER, FLORIDA, a municipal corporation, Party of the First Part, hereinafter called "City", and the CLEARWATER HIGH SCHOOL BAND BOOSTERS, a non- profit corporation, Party of the Second Part, hereinafter called "Boosters" ; WIT N E SSE T H: WHEREAS, the City desires to provide public parking for the spring training games conducted by the Philadelphia "Phillies" at Jack Russell Stadium; and WHEREAS, the Boosters desire to manage said public parking as a service and fund raising activity; and WHEREAS, the City desires to cooperate in such arrangement with the Boosters during the year 1985; NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS FOLLOWS: 1. The City, for the purpose of public parking, will make avail- able the following stadium parking lot and additional lots: The stadium parking lot located between Stadium Drive on the East, Greenwood Avenue on the West, Seminole Street on the South, and Palmetto Street on the North. AND On City of Clearwater property located East of Missouri Avenue bounded by Palmetto Street on the North and Seminole Street on the South. AND On Green Field located between Greenwood and Pennsylvania Avenues and bounded by Palmetto Street on the North and private property on the South. Public parking will be permitted on the Green Field location when the other two lots are filled, provided that at no time will parking be permitted within the fenced in softball field area located at Green Field. . .. " ..... - .:""l' "" I I Boosters shall hire two (2) off duty policemen, stripe the parking lots to assure maximum parking arrangements, and shall retain, if possible, a sufficient number of Booster volunteers as deemed necessary to reduce or eliminate the illegal parking of vehicles after each game begins. The City, through its Police Department, will provide sufficient police patrols to further assist the Boosters in the orderly flow of traffic and parking around the stadium. 3. This Agreement shall commence with the first home game of the 1985 spring training season by the Philadelphia "Phillies" and shall terminate following the seventh home game of that spring training season. 4. The Boosters are authorized to charge One Dollar ($1.00 = $.95 plus $.05 sales tax) per each automobile parked at the designated parking facilities described in Paragraph One (1). From the revenues collected at each parking site the following division is to be made: Five percent (5%) of the gross revenue shall be remitted to the City as payment of State sales tax, sixty percent (60%) of the remaining revenues may be retained by the Boosters and forty percent (40%) shall be remitted to the City. Within thirty (30) days following the end of the season, the Boosters, by game, will provide the City a final report of all receipts collected at each of the lots named herein and at the same time remit to the City a draft or check covering the total percentage payments described herein. Further, the Boosters will include in its report an accounting for the number of cars parked by use of prenumbered tickets listing first and last ticket numbers for each lot and for each game. 5. As part of their management function, the Boosters agree to hold in reserve fifty (50) parking spaces fronting on Stadium Drive in the first row directly across from the ticket office extending from Seminole to Palmetto Streets, which said spaces shall be free ____, L___ J1__ ____ _r" _r-r~_~_'_ . ~ -. .L~ ..... ," I I 6. It is understood that the Boosters presently have in force a liability insurance policy such as would apply to the activities proposed in this Agreement. The Boosters shall provide satisfactory evidence to the City prior to the start of the first game that it presently has in force a liability insurance policy such as would cover the City for all personal injury and property damage claims that might arise during the term of this Agreement.
