PARKING MANAGEMENT AGREEMENT/PHILLIES (2) I I PARKING MANAGEMENT AGREEMENT THIS AGREEMENT made and entered into this /: d" day of l??r (C~L(},tAJA.D.~ by and between the CITY OF CLEARWATER, am' icipal corporation, Party of the First Part, hereinafter called "City", and the CLEARWATER HIGH SCHOOL BAND BOOSTERS, a non-profit corporation, Party of the Second Part, hereinafter called "Boosters"; WITNESSETH: WHEREAS, the City desires to provide public parking for the spring training games conducted by the Philadelphia "Phillies" at Jack Russell Stadium; and WHEREAS, the Boosters have managed such parking facilities for the City in the pas t; and WHEREAS, the City desires to continue such arrangement with the Boosters during the year 1978; NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS FOLLOWS: 1. The City, for the purpose of public parking, will make available the following stadium parking lot and additional lots: The stadium parking lot located between Stadium Drive on the East, Greenwood Avenue on the West, Seminole Street on the South, and Palmetto Street on the North. AND On City of Clearwater property located East of Missouri Avenue bounded by Palmetto Street on the North and Seminole Street on the South. AND On Green Field located between Greenwood and Pennsylvania Avenues and bounded by Palmetto Street on the North and private property on the South. Public parking will be permitted on the Green Field location when the other two lots are filled, provided that at no time will parking be permitted on the clay areas located at Green Field. 2. The Boosters agree to be responsible for the orderly parking of all vehicles in each of the designate;tjfots. The Boosters agree to coordinate -1- r.......1 ~--:-) DU (3) I I all parking with the Clearwater Police Department to the end that an orderly flow of traffic is established in and around Jack Russell Stadium. The City, through its Police Department, will provide a parking procedure such as can be utilized by the Boosters. 3. This Agreement shall commence with the opening of spring training by the Philadelphia "Phillies" and shall terminate following the final day of spring training at which public attendance is permitted. 4. The Boosters are authorized to charge fifty cents ($.50) per each automobile parked at the designated parking facilities described in Paragraph One (1). From the gross revenues collected at each parking site the following division is to be made: Seventy per cent (70%) may be retained by the Boosters and thirty per cent (30%) shall be remitted to the City. Within thirty (30) days following the end of the season, the Boosters will provide the City a final report of all receipts collected at each of the lots named herein and at the same time remit to the City a draft or check covering the total percentage payment described herein. In addition to the percentage payment, which will be remitted at the conclusion of the season, the Boosters shall provide a weekly report to the Parks and Recreation Director containing the total receipts collected at each lot each day of the week being reported. Prior to the utilization of the lots described herein, the Boosters shall provide the Parks and Recreation Director a written statement detailing the manner in which it will collect the data required for the accounting report described herein. 5. As a part of their management function, the Boosters agree to hold in reserve fifty (50) parking spaces fronting on Stadium Drive in the first row directly across from the ticket office extending from Seminole to Palmetto Streets, which said spa.<;;es shall be free and for the use of officials, players, members of the press, visiting officials and groundskeepers. The owner of each vehicle permitted to park in one of the designated fifty (50) spaces shall be provided with an identification sticker which shall be displayed on the vehicle. -2- II> i'" , . I I 6. It is understood that the Boosters presently have in force a liability insurance policy such as would apply to the activities proposed in this Agreement. The Boosters shall provide satisfactory evidence to the City that it presently has in force a liability insurance policy such as would cover the City for all property damage claims that might arise during the te~m of this Agreemebt.
