made and entered into this

, A.D. 1974, by and between the CITY OF CLEARWATER,
FLORIDA, a municipal corporation, hereinafter referred to as IICity!I, and
CLEARWATER COUNTRY CLUB, a Florida corporation, hereinafter referred
to as "Club";
WITNESSETH:
WHEREAS, the Club has requested a permit to install a deep well
on the Club1s golf course; and
WHEREAS, the City is willing to issue such a well permit subject to
certain conditions and provisions;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. The City will issue a deep well permit for the drilling of a 10"
well to the Club provided, however, that the well shall be located no closer
to the City1s existing well at the Boy Scout Hut than 2,000 feet.
2. Provided that the quality of the water in the new well will be suitable
potable water and will meet the City of Clearwater1s standards of drinking water,
the Club will turn the well over to the City at such time that the City provides
suitable waste water effluent from the Marshall Street Plant for irrigation
purposes, subject to the following conditions:
a. The City will pay the cost of installing the irrigation line
from Marshall Street Pollution Control facility.
b. If there is a charge for this irrigation water, then the Club
will be credited for the amount spe;nt on the drilling of the well
against these waste water charges.
c. The City will pay the expense of installing the new raw water
line from the new well to tie into its pres ent water system.
d. If it is determined that the waste water will be furnished at no
charge to the Club, then the well shall become the property of
the City at no cost to it when suitable waste water is delivered
to the Club1s irrigation system.

3. . This Agreement shall inure to the benefit of and be obligatory upon
the successors and assigns of the respective parties hereto.
