between CLEAR\'JATER BAY ~IARINE \~AYS, INC., a Florida corpora-
~on, and the CITY OF CLEARWATER, Clearwater, Florida, .
\vl TNESSETII THAT:
WHEREAS the parties have exchanged certain lands
on the north and south side of a Westerly projection of the
North Lot Line of Lot 21.of Sue Barco's Subdivision, as
recorded in Plat Book I, Page 26 of the Publ ic Records of
Pinellas County,' Florida; said projection extending to the
channel of Clearwater Bay, and
\vllEREAS the said the CLEAR\vATER BAY t.IARINE \vAYS, INC.
for and in consideration of the exchange of said property,
hereby covenants and agrees to construct a seawall on the
North side of the fill which I ies to the West of the Sue
Barco Subdivision, before described, said seawall to be con-
~ructed in accordance with specifications and requirements as
set forth by City Engineer of the City of Clearwater, construct-
bn to commence on or before
one year from date
, and to
be completed with reasonable dil igence, bar act of God or war.
Said CLEARWATER BAY r.!ARINE \vAYS, INC. further agrees not to
construct covered boat sheds along the aforesaid fill beyond
a point seven hundred fifty (750) feet West of the West Lot
Lines of the said Sue Barco Subdivision.
