AGREEMENT THIS AGREEMENT entered into on this -y'V day of ~~, 1977, by and between the CITY OF CLEARWATER, Pinellas County, Florida, hereinafter referred to as "Clearwater" and the CITY OF ST. PETERSBURG, Pinellas County, Florida, hereinafter referred to as liSt. Petersburg'!; WIT N E SSE T H: WHEREAS, both St. Petersburg and Clearwater have concluded that a scientifically operated sanitary landfill is the most efficient method both economically and environmentally for disposing of solid waste today; and WHEREAS, St. Petersburg and Clearwater desire to continue disposing of their solid wastes at Toytown through the use of a scientifically operated sani- tary landfill until the County's Resource Recovery Facility becomes fully opera- tiona1; NOW, THEREFORE, BE IT MUTUALLY AGREED AS FOLLOWS: 1. St. Petersburg agrees to accept from Clearwater and Clearwater agrees to deliver Clearwater's solid waste (together with the wastes of those cities for which Clearwater is presently and may become in the future contractu- ally obligated) in a minimum amount of sixty thousand tons (60,000) a year. Such wastes are to be disposed of at the Toy town Sanitary Landfill or at a site the City of St. Petersburg may be permitted for in the future. 2. Clearwater agrees to pay St. Petersburg Four Dollars and Fifty Cents ($4.50) per ton for such disposal service effective October first (1), 1977. Said price shall be in effect for one (1) year, and the price per ton would be adjusted in accordance with fees set by the County Commission. 3. It is agreed by the parties that the delivery of such wastes shall be made by Clearwater to St. Petersburg at the City's present sanita ry landfill or to such other available landfills as a re designated by St. Petersburg within a radius of four (4) miles of the 1-275 I\oosevelt Boulevard Interchange. 4. This agreement shall be for a period of five (5) years from the above date unless terminated earlier by mutual agreement or by either party I t becoming contractually obligated or otherwise legally bound to a County Resource Recovery Disposal System operated by the County or by a third party. A County Resource Recovery Disposal System for the purposes of this agreement is defined as a system having the capacity of disposing of four hundred thousand (400,000) tons of solid wastes a year available for use at a fee to both under- signed parties and to at least five (5) more other governmental units. 5. It is agreement that St. Petersburg will make every diligent effort to acquire such lands as are necessary to the parties' joint use within the four (4) miles of the Interchange as listed above in Paragraph 3 for sanitary landfill purposes. 6. It is agreed by St. Petersburg and Clearwater that this agreement shall=cancel and replace the agreement between both parties made on the 8th day of July, 1971 for the operation and use of a sanitary landfill waste disposal system and said agreement, together with all subsequent changes and amend- ments thereto is hereby terminated in its entirety.
