INTERLOCAL AGREEMENT RE CLEARWATER LIBRARY FACILITIES ~ _.1 INTERLOCAL AGREEMENT I J: ~ THIS AGREEMENT is made and entered into this / ~ day of '11~ 1991, by and between Belleair Bluffs, a municipal corporation of the State of Florida, hereinafter referred to as "Belleair Bluffs", and the City of Clearwater, a municipal corporation of the State of Florida, hereinafter referred to as "Clearwater", as follows: WIT N E SSE T H: WHEREAS, all parties desire to provide for Library Services; and WHEREAS, this Interlocal Agreement is authorized by the provisions of Section 163.01, Florida Statutes, which authorizes the cooperative exercise by agreement of two or more public agencies of any power common to them. NOW, THEREFORE, in consideration of the covenants herein contained and other good and valuable consideration, the CITIES agree as follows: Section 1. CONDITIONS FOR AGREEMENT. A. Clearwater will provide public library service to Belleair Bluffs residents having certification of residency issued by Belleair Bluffs at any of the Clearwater' Library facilities. At the time of execution of this Agreement and from time to time thereafter as necessary, Belleair . Bluffs will provide updated information for the Clearwater Library to know the incorporated boundaries to determine Belleair Bluffs residency. B. Belleair Bluffs will pay 100% of the applicable nonresident library card fees for Belleair Bluffs residents desiring Clearwater borrowing privileges. These fees are set forth in Resolution Number 88-38 and incorporated herein by reference, which may be amended from time to time. C. Clearwater will notify Belleair Bluffs by August 15, 1992 of any nonresident library user rate increase to become effective in fiscal year 1993 and will notify by August 15 of any subsequent year that this agreement in effect. If no such notification occurs by August 15, the then current rate shall remain in effect for the subsequent municipal fiscal year, October 1 - September 30, without increase. D. Belleair Bluffs residents using Clearwater Library cards will follow the circulation policies of the Clearwater Public Library. E. Belleair Bluffs will pay the cost of book courier service to and from a mutually selected Belleair Bluffs site up to a maximum of five days per week on days that Clearwater is regularly scheduled to have service. Belleair Blum-jwill provide and pay for the insta1laticl of an in-wall book return designed to protect library materials and carrying bags at a mutually agreed location. G. Clearwater will submit monthly bills for all cards issued to Belleair Bluffs residents cards issued and for the book courier service. Belleair Bluffs will reimburse the City of Clearwater within thirty days of receipt of the monthly bill. Any disputes in the bill will be heard by the Director of Administrative Services for the City of Clearwater, whose decision shall be final. Section 2. EFFECTIVE DATE AND TERM. This Interlocal Agreement shall take effect upon the execution by both parties to this Interlocal Agreement and filing with the Clerk of the Circuit Court of Pinellas County, Florida. The initial term hereof shall be the 1991-92 fiscal year, ending on September 30, 1992. Either party may request to re-negotiate or terminate this agreement at least thirty days before the fiscal year concludes. The agreement will be automatically extended for another year if no such action is taken. Section 3. AMENDMENTS TO AGREEMENT. This Interlocal Agreement may be amended, in writing, upon the express formal consent of the governing bodies of all the parties. LEGAL AUTHORITY. This Agreement is entered into pursuant to the provisions of section 163.01, F.S., the "Florida Interlocal Cooperation Act of 1969." 2. MUNICIPAL STATUS. Both of the parties are municipal corporations of the State of Florida located in pinellas County, possessing those powers provided in their Charters and granted to municipalities by general law, including the power to render municipal serVlces such as fire control and suppression services. 3. SCOPE OF SERVICE. CLEARWATER shall provide the services of Assistant Fire Chief, Joseph A. pidala ("Employee"), to serve as the Fire Chief of the City of Belleair Bluffs Fire Department. In the event, for any reason, the Employee's services are unsatisfactory to BELLEAIR BLUFFS or CLEARWATER determines that it 2 J I PINELLAS COUNTY FLA. IFF.REC.BK 8707 PG 98 is inappropriate for the continuance of such services by the Employee, the parties shall mutually agree upon another employee of the City of Clearwater Fire Department for the provision of such services. If the parties are unable to agree upon another employee of the City of Clearwater Fire Department for the provision of such services, this Agreement may be terminated by either party upon fifteen days notice in writing to the other party. 4. TERM. The term of this Agreement is for the period commencing May 16, 1994 and ending November 16, 1994. This Agreement may be extended for additional periods of time by mutual agreement of the parties evidenced by an exchange of correspondence extending the duration of this Agreement to a date certain. Either party, during the term of this Agreement, may terminate this Agreement upon sixty days notice in writing to the other party. 5. EMPLOYEE STATUS. The Employee shall continue to be in all respects an employee of CLEARWATER, except that during the term of this Agreement, the Employee shall administer the Fire Department of BELLEAIR BLUFFS in accordance with the policies of BELLEAIR BLUFFS and in accordance with direction received by the person or persons charged with the responsibility for the supervision of the Fire Chief of BELLEAIR BLUFFS. In the event of the illness or unavailability of the Employee, CLEARWATER shall provide another employee of CLEARWATER who is mutually acceptable to both parties to provide the services contracted for hereunder. The Employee shall recelve all pay and other employment benefits from the CLEARWATER and no separate compensation, insurance, 3 , ' I PINELLAS COUNTY FLA. __t!,~_-!_~~_.~~_8~07_~~____~_?_ retirement benefit, workers compensation benefits, or other remuneration or benefit of any other type shall be paid by or due from BELLEAIR BLUFFS to the Employee. 6. COMPENSATION. In full and complete payment of services rendered hereunder, BELLEAIR BLUFFS shall pay to CLEARWATER the sum ~~ ~~ $3,200.00 ,,-Jf ~r:~g:jx.x5dit per month, payable on the 16th day of each month ~Uring the term of this Agreement, in advance. Any partial month shall be paid on a per diem basis based on a thirty day month. 7. EMPLOYMENT STATUS. During the term of this Agreement, the Employee shall not be deemed for any purpose to be an employee of BELLEAIR BLUFFS but shall continue his employment status as an employee of CLEARWATER. 8. RECORDATION. This Agreement and all subsequent amendments hereto shall be filed with the Clerk of the Circuit Court in pinellas County and a copy thereof shall be filed with the Secretary of State of the State of Florida not later than thirty days of the date of this Agreement and this Agreement shall become effective only upon being filed with the Clerk of the Circuit Court of pinellas County. 9. NOTICES. This Agreement contains the entire understanding between the parties and any amendment hereto except for the exchange of letters extending the duration hereof, shall be in writing, approved by the govern~ng party of each body, and shall be executed with the same formality as this Agreement is executed and shall be filed with the Clerk of the Court of pinellas County, and the Secretary of State of the State of Florida.
