which are attached hereto as Exhibit A (if applicable) to be conveyed or paid prior to the
second ordinance reading effectuating the annexation of the subject property;
(d) that at such time as it becomes possible for the City to annex said real property, this
Agreement will constitute an application to annex at that time, and the City will have the right, upon
sixty (60) days written notice to the property owner, to initiate ,action to annex the property to the
City;

eventual intorporation of the property within the City, to have site and building plans reviewed and 0'\
accepted by the City in advance of obtaining any requisite permit from Pinellas County. Acceptance
of such plans shall precede the execution of this Agreement by the City and any construction on this
property shall comply with the applicable building and fire codes in effect in the City of Clearwater;
(f) that all of the property described above shall be deemed a single parcel subject to
annexation as provided herein, and any subparcels of the property described above which are created
by subdivision or by any other means shall be included for the purposes of the subsequent annexation
procedure, subsequent sale and individual ownership notwithstanding;
(g) that the terms and provisions of this Agreement shall be a commitment and obligation
which shall not only bind the present owner of said described real property, but shall be a covenant
which shall run with the land and shall bind and be enforceable against the heirs, successors and
assigns of the Owner; and
(h) if the Owner or the heirs, successors, and assigns of the Owner, shall default in the
performance of the terms and provisions of this Agreement, and the City shall institute legal
proceedings to enforce the terms and provisions hereof, the Owner or the heirs, successors and
assigns of the Owner shall pay all costs of such proceedings including the payment of a reasonable
attorney's fee in connection therewith.
3. The City shall not be liable for any damage resulting from any unavoidable cessation of
service caused by Act of God, necessary maintenance work, or any cause beyond the control of the
City.
4. All notices to be furnished hereunder shall be furnished to the City of Clearwater, to the
City Manager, P.O. Box 4748, Clearwater, Fiorida, .34618 and to thE:: owner at the post office address
for the property described above, at any other address which may be furnished by the Owner from
time to time. or at the address fer tlte Owner according to the property tax rolla of Pinellas County,
Florida.
5. This Agreement shall be recorded in the public records of Pinellas County, Florida.

hensive land use plan.
(j) The annexation of a property and its zoning and fire district designations shall become
effective upon second ordinance reading unless otherwise specifically provided for, and shall
thereafter be properly recorded in the official records of the city and filed with the department
of state as required by ~ 171.091, F.S., and as such section may be subsequently amended.

Sec. 132.005. Requirements.
(a) Reserved.
(b) Property to be annexed shall be consistent with the city's land use plan in terms of the
proposed category of land use. In the alternative, an acceptable amendment to such plan shall
be proposed, which amendment will be considered concurrently with the annexation request.
Also, the proposed zoning district classification shall be consistent with the applicable cate-
gory of the land use plan for the area under consideration.
(c) All petitions to annex that contemplate initiation of project development (other than
construction of one single-family or two-family dwelling) prior to the effective date of annexa-
tion cshall include all appropriate site plans, plats, and engineering plans to be submitted to
the city for review at the time the petition to annex is submitted. Such plans shall be reviewed
by the departments responsible for their consideration to determine the consistency of such
plans with the standards of the city which will apply to the development upon transfer of
jurisdiction to the city. Consistency of such plans with applicable city standards shall be a
prerequisite for approval of an annexation petition. Following such review, an annexation

(d) Owners of property to be annexed shall be responsible for the payment of impact fees

ARTICLE III. AGREEMENTS TO ANNEX
Sec. 132.006. Agreement procedure.
(a) Agreement-to-annex fonns are available at the office of the development code administrator.
(b) Any agreement to annex involving property which is either developed or to be devel-
oped with any use other than one single-family dwelling or two-family dwelling shall require
action by the city commission. Any agreement to annex involving property which is developed
or to be developed with one single-family dwelling or two-family dwelling shall be eligible for
administrative approval. Such administrative approval shall be by the city manager and only

where the manager d~termines the agreement does not involve the dedication of a street.
right-of-way, adversely affect the city's servicing capabilities, nor compromise the city's land
use planning program. Any agreement not approved by the city manager shall be forwarded
to the city commission for review and subsequent action.
(c) Upon determination by the development code administrator that an agreement to
annex conforms to all requirements of law and complies with all submission requirements
contained in section 132.011 of this chapter, the code administrator shall receive the agree-
ment and forward it to appropriate city departments for review and recommendation. Any
such departmental recommendation shall be returned to the code administrator by a date
certain established by the code administrator.
(d) The development code administrator shall forward the agreement to annex together
with the recommendations of reviewing departments to either the city commission or city
manager (in accord with the terms contained in preceding paragraph (b)) who shall evaluate
the city's ability to serve the property which is the subject of the agreement and act by
approving, approving subject to modification or conditions, or disapproving the agreement.
(e) Any approved agreement to annex, whether such approval was with or without
modification or conditions, shall be duly executed by the authorized city officials.
({) Annexation of the property which is the subject of the agreement shall occur at the
time and in the manner prescribed in the agreement, including compliance with all conditions

Sec. 132.007. Requirements.
(a) Reserved.
(b) All agreements to annex that contemplate initiation of project development (other
than construction of one single-family or two-family dwelling) prior to the effective date of
annexation shall include all appropriate site plans, plats, and engineering plans to be submit-
ted to the city for review at the time the agreement to annex is submitted. Such plans shall be
reviewed by the departments responsible for their consideration to determine the consistency
with the standards of the city which will apply to the development upon transfer of jurisdic-
tion to the city. Consistency of such plans with applicable city standards shall be a prerequi-
site for approval of an agreement to annex. Following such review, an agreement to annex
shall be approved, approved subject to modification or conditions, or disapproved with the
reason(s) for such disapproval noted. Subdivision plats and site plans shall contain the infor-
mation required by chapters 133 and 137.
(c) Owners of property entering into an agreement to annex shall be responsible for the
payment of impact fees to the city for those services to which the impact fees are attendant.
